Bay Area activist working to put Arizona-style immigration law on California ballot

BELMONT -- A Republican activist is raising signatures to place an Arizona-style immigration law on the California ballot in 2012.

The proposition would require all state and local police officers to investigate the immigration status of those they stop if they have reasonable suspicion that the person is in the country illegally. It would make it a state crime for illegal immigrants to seek work while concealing their immigration status. In addition, it would make it a state crime for an employer to hire an undocumented immigrant, whether the hiring happens intentionally or negligently.

Secretary of State Debra Bowen announced Tuesday that the proponent, Michael Erickson, could begin collecting signatures. He must collect the signatures of 433,971 voters by April 21 in order for the initiative to qualify for the 2012 ballot.

Erickson, a Belmont resident, calls the measure the Support Federal Immigration Law Initiative. The proposition would outlaw sanctuary city policies and allow residents to sue any state official or agency for as much as $5,000 per day if their policies restrict the enforcement of federal immigration laws. It also would require all employers in the state to use E-Verify, which checks the eligibility of workers through a federal database.

"Since we're never going to get something like this passed through the Democrat-controlled Legislature, it's going to be we the people who are going to make it happen," he said at a Bay Area tea party rally recently, according to a video of the rally at the initiative's website.

This already happened: proposition 185. It was approved overwhelmingly by the voters but the courts shut it down.

Even if all of Kaliphornia voted to use the Arizona model some federal judge will overturn it .... why bother?

Even if it qualifies for the ballot and passes, some left-wing judge will declare it unconstitutional or an infringement on federal sovereignty, etc. Any meaningful and lasting immigration law has to originate in Washington, D.C. and take the form of a constitutional amendment.

You need to pay closer attention....That occurred long ago, back in 1994, with Proposition 187, long before Arizona ever though about it....

187 would have put a stop to tax paid services for illegals....

The people of California voted overwhelming for it the proposition, won big.

The Feds along with their state government co-conspirators burned our ballots and declared our free election illegal.

The results of this massive government intrusion back in 1994, can be seen in every state, including yours.

No, I work there. I live in the Seattle area and am home for the Holidays ... didn’t know about that other thing though ...wasn’t old enough (9) to follow all that stuff ....

Well, if they look, they will find the Arizona law follows the pattern of a California law already on the books. Enforce what you have out there.

Good point. Unfortunately.

That's why its a shame that [commie] Kamala Harris squeaked through and won the Attorney General race. This proposition could win. The opponents of our National Sovereignty will shop around for one of the many leftist activist Judges (there always seem to be an infinite supply of these characters), the Judge will rule against the Proposition based on some contrived 'living Constitution' interpretation, and the State Attorney General will not take the side of the voting Public and let the Judge's ruling stand... Just like 187.

Nonetheless, I hope this proposition makes the ballot.

They had a law passed to prevent gay marriages too and some frigging judge shot it down. Arizonians passed a law that was shot down by a judge so I do not think this will work.

Not all judges are elected into office but most are appointees (correct me if I am wrong) but I do not think they should be appointed they all should be elected so they are accountable to the people and not a frigging politician.
