Portland Bomber Will Use Entrapment As Defense

But good luck to him. No terror case has ever won acquittal by using entrapment.

Mohamed Osman Mohamud, 19, a Somali-born naturalized U.S. citizen, has plead innocent to terror charges leveled against him. According to the FBI, he had several documented chances to back out of the attempted Christmas tree lighting bombing, but Mohamud’s defense claims that the very first meeting was not recorded, and that this meeting is the most important. This claim almost sounds like a conspiracy theory.

The details of this case are not clear to date. News sources do not know if Mohamud was approached by the FBI or if his father called the FBI to report his son’s recent extremism. If the father’s tip is the reason this investigation began, then his testimony is damning to any defense.

According to FBI files, Mohamed Osman Mohamud, was approached by the FBI six months ago. Although they did supply the van and explosives, agents contend that they constantly told the 19-year-old that he did not need to kill to become a good Muslim. Despite the apparent discouragement, agents claim that Mohamed Mohamud was insistent on carrying out this plot.

For a case to be won under entrapment, the prosecution has to prove that the perpetrator of the terror plot would have acted on his or her volition. If what the FBI claims is true, then there doesn’t seem to be much of a chance for this kid, even if the defense can strongly argue that a 19 year old is highly susceptible to influence.

Judge Andrew Napolitano was on the O’Bloviator show tonight saying this was clearly entrapment and will not stand, and he’s a pretty solid guy. It seems fair to say that it will be easy to prove the guy wanted to create mayhem but that is just an idea, not an act. And ideas aren’t illegal (yet).

The Jingle Bomber will probably be let off and given a settlement for all of the entrapment used to force him into this protest of US policies in the Muslim world.

He'll go on the lecture circuit at major universities and receive an honorary doctorate from Portland State.

He made me want ralph. We are not talking about thinking about knocking off a 7/11, or thinking about steeling a car. This guy was fully carrying the act out. If he was robbing a bank with an empty gun, he would still face armed robbery charges. in his case he was killing hundreds of people but the weapon failed to go off. Guilty in my book.

If the trial is held in Portland, the USA would be lucky to get a onviction on “Attempting to use a high explosive without a permit”.

Muslims could blow a number of Portland Liberals to the gates of hell and they would still think they were victims of Dick Cheney, Halliburton, WalMart, the BFEE, and the CIA before they would ever blame a member of the Religion of Peace.
