DHS Sued Over Alleged "Cover-up" in Illegal Immigrant DUI Probe

The death of a Benedictine nun in Prince William County, allegedly at the hands of a repeat DUI offender and illegal immigrant, has prompted a lawsuit and allegations of a federal government cover-up.

The self-described watchdog group Judicial Watch said it's suing the Department of Homeland Security for failing to disclose its information on the driver accused in the case.

That driver is Carlos Martinelly-Montano, an undocumented citizen who came to the United States from Bolivia as a child. He had two previous DUI convictions and was released from jail in 2008 to await deportation proceedings.

Authorities said he was under the influence when he allegedly crashed a vehicle into another that was carrying three nuns on Aug. 1.

Sister Denise Mosier was killed in that collision. The other nuns suffered serious injuries.

Shortly after the crash, the Department of Homeland Security announced it would launch its own investigation into why Montano was still in the country and driving, given his criminal record. DHS oversees Immigration and Customs Enforcement.

I suppose nothing a lamestream reporter does should surprise me, but then yet another atrocity leaps out and catches my eye.

“The self-described watchdog group Judicial Watch.”

Would any lamestream reporter write “The self-described watchdog group Southern Poverty Law Center” or “The self-described Jewish Anti-Defamation League”? Yet those organizations deserve the label far more than Judicial Watch.

Whenever an illegal alien kills someone in a drunk driving accident or something similar, here’s what I recommend:
What can we do about it? Here’s my standard post.

RICO —Citizen Recourse

Private persons and entities may initiate civil suits to obtain injunctions and treble damages against enterprises that conspire to or actually violate federal alien smuggling, harboring, or document fraud statutes, under the Racketeer-Influenced and Corrupt Organizations (RICO). The pattern of racketeering activity is defined as commission of two or more of the listed crimes. A RICO enterprise can be any individual legal entity, or a group of individuals who are not a legal entity but are associated in fact, and can include nonprofit associations.

Here’s what I’ve been pushing: it’s time to file Racketeering, Influencing, and Corrupt Organizations (RICO) lawsuits.

RICO lawyers could turn it around in a few years and MAKE MONEY at the same time. I’m surprised they haven’t done it already.

In the absence of enforcement, we can get the word out in the meantime that there is money to be made in filing RICO lawsuits against employers who hire illegal aliens like this jerk.

Employers would have no trouble shutting down the border if they could get sued by someone under the RICO statutes for hiring these people in the first place. The next time an illegal alien kills someone in a drunk driving accident or somesuch thing, I’m going to point out that the victim’s family might be able to seek compensation from the employer under these statutes in the hopes that it would catch on. If this did catch on, would see such a swift backlash against illegal immigration that no employer would go near these people and they’ll all simply want to go back home.

DHS flaunts the same laws it is supposed to enforce. Nothing to see here but new Democratic voters-to-be, move along.

Far as I can tell, Judicial Watch spends its time papering the immediate world with grandiose press releases and begging for money. I'd love to see some proof to the contrary.

Judicial Watch got a lot of documents released during the Clinton Impeachment mess. Probably would not have gone so far if JW did not go after the Clintons getting stuff released that they were hiding

Larry Klayman does not have much to do with JW anymore. He left the organization when he ran for US senate a few years ago.

I can understand the suspicions people have about groups like JW...many are just fund-raisers and do nothing constructive. JW does have some successes they can hang their hats on.
