If no legislation is passed in the lame duck session regarding tax rates, can the new congress pass legislation that would be retroactive to Jan.1 2011? If they can with their new numbers, then the burden would be placed directly on Obama would it not?”

Sure, the new congress could attempt this. The problem is, there wouldn’t be enough votes in the senate to override the Marxist president’s veto.
