Topeka (WIBW) - An apartment resident who shot and killed an intruder will not face charges.
Shawnee County District Attorney Chad Taylor said Wednesday he reviewed the case and determined 46-year old Normon Hammond acted "well-within his lawful rights to protect himself and others from immediate harm."
Topeka Police say Hammond fired shots at 49-year old Edward Bowens early Saturday morning, as Bowens was breaking into Hammond's apartment. The two lived at the same apartment complex at SW 12th and Polk.
With Bowens' death, Taylor says his office considers the case closed.

These stories always make me smile. But I have to say that in MA there is virtually no way a citizen can defend himself like this. If a guy is kicking in my door, I am legally obligated to run to the back of my house and try to leave if possible. If backed into a corner (literally), I can shoot, but the burden of proof is on me to show that I had no other option. And if my gun isn’t registered, it’s an automatic year in jail for me.
This is a step in the right direction. Now, if we could just convince Topeka’s Phelps family to protest gays and the military by breaking into houses and apartments!
If you keep two loaded guns in your house, one at each end. Are you going to back out of your house leaving a loading firearm for the intruder to use on you?
