The 35-year-old Long Beach man killed in an officer-involved shooting Sunday was holding a pistol-grip water nozzle, not a gun, Long Beach police officials said Monday.

Two officers responded to a 911 call at 4:40 p.m. Sunday from a neighbor reporting an intoxicated man holding a "six-shooter" in the 5300 block of East Ocean Boulevard in the upscale Belmont Shore neighborhood.

"The officers had a position of cover and were observing the suspect while other officers were en route," said Sgt. Dina Zapalski, a spokeswoman for the Long Beach Police Department.

Zapalski said Douglas Zerby had been sitting on a stoop playing with what appeared to be a weapon and pointing it at objects as if it were a gun. He extended his arms and pointed in the direction of an officer. Police said they did not have time to make their presence known or to tell Zerby to drop the weapon before opening fire because they believed he was a threat.

“so you think it is ok for the cops to sneak into your neighbors backyard and from behind cover and without warning of any kind ,”

No, but I hadn’t heard that part until I read this story. Perhaps you didn’t read my post. I know its common not to read the actual stories but you should at least read the thread before throwing stones.

I am sure that the Cops-Can-Do-No-Wrong crowd on this forum can explain why the guy deserved to be killed. And justify the cops actions. If they haven’t already.

For the life of me I can not understand Why These Jack Booted Thugs are not in Jail for First Degree Murder, with Special Circumstances of Lying in Wait.along with the 911 caller and the dispatcher too, they all belong in JAIL. THIS WAS A NON CRIME, There was nothing illegal , No reasonable person could conclude that a crime was being committed, therefore No Police Officer could have REASONABLE SUSPICION a CRIME was being or about to be committed. SHOW ME THE SECTION OF THE PENAL CODE THAT WHAT THIS MAN WAS DOING WAS A CRIME, EVEN IF HE DID HAVE A GUN.

Police said they did not have time to make their presence known

"Police, drop the gun"

Yeah, that takes way too long to say, when your standing behind cover, holding a shotgun....

I have followed this story since it happened, i have listened to the tapes,police,sisters,brother,ex-wife, neighbors,reporters,... EVERYBODY, and NOT ONE OF THEM, HAS BOTHERED TO ASK or ANSWER A BASIC SIMPLE QUESTION, WAS HE DOING ANYTHING ILLEGAL?? The answer is NO. Even if he had a gun, which he didn’t.

Oh sure...Right...It's aways better for the cops, who are standing behind walls and pillars, holding shotguns no less, not to say, "Police, drop the gun"...

Shoot first!!

Do you expect anyone to be arrested for this? They may arrrest the poor soul they killed, but that is about as far as it will go.

To say the least.

And I remember way back in another century when the cops were considered your friends. That kinda dates me.

Now I avoid them and stay as far from them as I can.

The answer is simple. We as a nation have been conditioned to not question authority (especially in the form of badged police officers) and to believe the Officer Friendly model of law enforcement exists. All they have to say is ‘we thought we were in danger’ and the populace laps it up. Sucks to be the bullet-ridden guy on the ground, but the police kept us ‘safe’ yes? And their job is just so hard, and their pay is oh-so-low. And you are just so un-American for questioning them! You must have something to hide!

See how easy it is? Ostracize those who question, and you can rule the world. And that will be $1.25 for the bullet used to execute you, citizen.

Can I be honest?

Some advise...

Don't ever call the cops, or any government agents unless you're being attacked by hordes of AIDs infected cannibals...
