Miller was smug and lazy. Murcow didn’t win it, Miller lost it.
The Federal Judge, Ralph Beistline, is a JWBush appointee from 2001. He completely agreed with the Alaska Supreme Court.
He dismissed Miller’s complaint “with prejudice”. This is rare; it means that Miller cannot file another case or appeal. (Beistline could have dismissed “with leave”, which would have allowed some options for Miller.) It means that the Judge found Miller’s complaint totally without merit, and in some issues “frivolous”.
It is a stinging rebuke to Miller’s arguments.
