Via Eyeblast. The good news? This clip has become such a hit among righties on Twitter that Iowahawk was inspired to cook something up in honor of it. The bad news? I think Klein’s getting a bit of a bad rap. His formulation is idiotic — not all old texts are confusing, of course — but that’s probably just rhetorical clumsiness while live on the air. All he means, I take it, is that it’s often not clear how constitutional provisions should apply to modern circumstances not envisioned by the Founders.

This is why there are 5-4 decisions all the time on the Supreme Court, and even splits within the Court’s conservative wing, on matters of huge constitutional import. (It pains me to remind you that Scalia concurred with the judgment of the majority in the Raich case.) Here’s Klein elaborating at his WaPo blog:

Constitution is perfectly clear when the left discovers new governmental powers in there. When it doesn’t, it’s confusing.

The Constitution ois confusing to leftists because it does not grant total control over every aspect of a citizens life by the Federal Government. They lack the ability to grasp the concepts of freedom and liberty.

My main problem with Klein’s argument is simply that he misidentifies the source of constitutional ambiguity: It’s not so much that the document is old, it’s that it’s remarkably terse.

In the actual words of the Constitution, in the words of the Federalist Papers and in the actions and writing of other creators of the Constitution, one thing is very CLEAR in the intention of the US Constitution: our government is designed to be a LIMITED and CONSTRAINED operation. The Founders had experience with an expanding and controlling government in the British and wanted to forbid such expansion against our own citizenry.

Nothing is more of an anathema to the current Progressive / Liberal than a constrained central government. For them to achieve their “best of all worlds”, they need a government that they will control as the natural political masters.

As such they MUST DIMINISH the US Constitution into a dated document that is more a shadow of an ideal rather than the SUPREME LAW of this Country. This is but one of a storm of attacks, past and future, that will be sent against the United States Constitution as the “Pole Star” of our governance to make room for their expansionist ideals of a more ‘able’ government.
