Schwarzenegger partially commutes manslaughter sentence of Esteban Nunez

Gov. Arnold Schwarzenegger, just hours before leaving the governor’s office, shaved nine years off the combined 16-year sentence of Esteban Nunez, the son of former Assembly Speaker Fabian Nunez.

The younger Nunez was one of three young men charged in a knife fight near San Diego State University in October 2008, in which Luis Dos Santos was stabbed to death. The man who wielded the knife in the fatal attack, Ryan Jett, entered a plea agreement with prosecutors and was sentenced to state prison.

Esteban Nunez wielded a knife that injured another participant in the fight. He pleaded guilty to voluntary manslaughter with the use of a knife, and assault with a deadly weapon.

“I do not discount the gravity of the offense. But given (Esteban) Nunez’s limited role in Santos’s death, and considering that, unlike Jett, Nunez had no criminal record prior to this offense, I believe Nunez’s sentence is excessive. Accordingly, I commute Nunez’s sentence to the lower term for the crimes for which he was convicted: seven years in state prison,” the governor wrote on Sunday in announcing the partial commutation.

Nice drafting: “Nunez wielded THE KNIFE THAT,,,” injured another person. The knife did it. By the way, how badly did THE KNIFE hurt the victim? What vermin these people are.

Ah-huh. And if this particular Nunez had been some guy from El Sereno instead of the son of some powerful state politician, I’m sure Arnie would have been just as eager. /do I even need a sarc tag here?

He may of had a “limited” roll in the murder but he was Front and Center in the subsequent cover up.

Limited or not the fact remains that he participated.

I feel so badly for the family of the murder victim.
They must be livid.

Not surprisingly, there are different versions of the fight. However, the following key facts are
not in dispute: During the fight, Jett stabbed Santos once through the chest, severing his heart.
Robertson and Henderson were also stabbed. According to Nunez’s sentencing brief, Nunez
admitted he stabbed Henderson in the stomach. Scheerer also joined the fight, and Thomas
punched him in the eye.
Jett, Nunez, Garcia, and Thomas left the scene. Thomas drove the group to Sacramento.
Once there, they went to the Sacramento River, burned their clothes, and threw their knives in
the river.

Nunez was 19 years old at the time of the offense, and he had no previous criminal record. He
subsequently pled guilty to voluntary manslaughter with the use of a knife. He also pled guilty to
assaulting Henderson and Robertson with a deadly weapon, and he admitted that he inflicted
great bodily injury on Henderson and Robertson. Nunez was sentenced to an aggregate term
of 16 years in state prison. The court imposed the maximum 11-year sentence for voluntary
manslaughter, plus one year for using a knife. The court also sentenced Nunez to one year for
assaulting Henderson with a deadly weapon, plus one year for inflicting great bodily injury.
Similarly, the court sentenced Nunez to one year for assaulting Robertson with a deadly
weapon, plus one year for inflicting great bodily injury.

To me they are rich and famous ... and Luis was a star in our eyes. We will never get to see his face again...”

“It was a very, very difficult decision for the family to work through this, (the plea agreement)” Patton said. “We very much wanted to go to trial to get the real truth of the case out but it’s a tragic situation all the way around and Esteban is ready to take responsibility for his role in the event.”

Some of us knew that Arnold was a loser from the very start. Others, the Hugh Hewitt crowd comes to mind, brayed that Tom McClintock “couldn’t win” and insisted that everyone had to back Schwarzenegger. Keep that in mind the next time you see Hewitt and his Salem Radio pals pushing another squishy “center-right” phony in the next election.

I believe his sentence is disproportionate in comparison to Jett’s.

Horse manure. Jett committed first degree murder, even by California code. That he reached a plea agreement is germane to the Schwarzenegger's lame excuse.

I'm no fan of determinate sentencing but this is a case of the cart pulling the horse. Had not Fabian Nunez been involved, Jett would be in San Quinton and the younger would deservedly be in general population at Corcoran. Jett certainly owes Nunez a debt of gratitude.

A classic case of corruption and malfeasance in high public office. Will no one rid me of this Austrian menace?
