Schwarzenegger's commutation for Nunez criticized

Former Gov. Arnold Schwarzenegger's decision to reduce the prison sentence of a former Assembly speaker's son sparked outrage Monday, from the district attorney who prosecuted Esteban Núñez to local families whose loved ones are spending more time in prison – for lesser crimes.

"We were shocked to hear of the governor's last-minute commutation, which greatly diminishes justice for victim Luis Santos and re-victimizes his family and friends," San Diego County District Attorney Bonnie Dumanis said in a prepared statement.

She said her office was not consulted about the sentence reduction, in which Núñez's prison term was cut from 16 years to seven in the 2008 stabbing death of a college student in San Diego. At the time, Núñez, son of Fabian Núñez, told friends involved with the crime that he would "take the rap for it" and hoped that his father would "take care of it," according to a 2008 arrest warrant affidavit.

The killing happened when Núñez and his friends started a fight after being turned away from a fraternity party. Núñez did not inflict the wound that killed Luis Dos Santos, but took the same plea deal as his friend who did. Núñez and Ryan Jett both pleaded guilty to voluntary manslaughter and two counts of assault with a deadly weapon. Both were sentenced to 16 years in prison.

Schwarzenegger's commutation message said the two didn't deserve the same sentence because Jett had a criminal record and fatally stabbed Santos, while Núñez had no criminal record and only aided and abetted in the killing.

Helped with the killing however he did knife 3 guys that went to the hospital and survived.

Mr. Kennedy is a failure. But lets us hearken back to my thoughts I have posted about him for years.

He played Conan the Barbarian. He thinks he is Richard the LionHeart but in the end was simply an actor. The court jester and will go down in history as; Arnold the Fool.

Well, at least the courts have put the brakes on Arnold the Awful’s scheme to peddle a bunch of state buildings to Diane Feinswine’s husband and Henry Cisneros. It’s going to be interesting to see what Jerry the Fairy does now that he’s back. He certainly didn’t do anything but warm a chair in Oakland.

I don't understand the objection here, Esteban Núñez has repented and gotten a productive job as Kamala Harris’ chief of staff, what more could you want.

Initially I thought there might be some 'argument' to reducing the sentence, even while still seeing 7 yrs as too much a reduction.

However, seeing even the D.A. wasn't consulted, I have to say this had to be just political and the justification was mostly a fig leaf. To my recollection, the L.A. Times piece did not indicate Jett, the fatal stabber, took the same plea, just that they had the same sentence.

This article, and another I read yesterday, suggested the judge was protecting himself because we election judges in San Diego. As a voter, I know it wouldn't have made a hill of beans difference. It's hard to find out information on local judges because they don't campaign like normal candidates and hide behind claims of "ethics" rules preventing them from doing so.

If it'd been any of us, we'd not have gotten a commutation.
