Why a 2:1 decision at the appellate level? Is the law written so poorly that three astute judges can’t agree as to what the law actually says? Or, are the three judges so inept that they can’t read a simple law and all agree as to the meaning and intent of the law? Or is at least one judge so corrupt that he’ll read whatever he wants into the law.
