CHARLESTON, W.Va. — Three U.S. marshals were shot while trying to serve a warrant in Elkins this morning. The man who shot them was then killed by law enforcement, according to sources close to the investigation.

The marshals and State Police troopers were at the home of Charles Smith at about 8:30 a.m. to serve a warrant on him for failing to appear in court on possession of drugs and firearms charges, according to sources.

After announcing that they were there to serve a warrant, officers breached the door and stepped into the house.

Smith then opened fire with a shotgun, hitting one marshal in the neck, one in his bulletproof vest and one in the arm or hand, according to sources.

A marshal and trooper then fired at Smith, killing him, according to sources. The trooper likely fired the shot that killed him, sources say.

The marshal shot through the neck was transported to Ruby Memorial Hospital in Morgantown. His condition is unknown.

A statement from the U.S. Marshal’s office confirmed that three marshals were shot and that two were taken to a local hospital for treatment and one was transported by helicopter.

State Police spokesman Sgt. Michael Baylous could only confirm that there was a shooting incident in Elkins while officers attempted to serve a warrant.

Of course we would prefer to only need to use our voice commands and get total compliance, but sometimes that doesn't happen.

Very well. If we ever meet, I'll do as I'm told.

Cheers.

And when individual's rights are violated, who should people call? You?

Not everyone can be as self-sufficient as you I guess. I hope neither you nor your family ever has to dial 911.

Look, you’re just going to keep talking about busting in on innocent civilians like it’s the norm. It isn’t, and as long as you hold on to your ridiculous notions we’ll just agree to disagree. Does it happen? Yes, very infrequently. Is it wrong? Yup. Should we never issue warrants because of the infantesimal chance that it’ll go bad? Nope.

If many police have your attitude then hopefully few will call.

Apparently so, given the usual cop-bashers here on FR. Ironic, though, these same bashers go silent when an officer dies, but if an officer survives, they attack the officer.

Sad.

I’ll take my awards, thank-you cards, respect from bosses and coworkers, and hugs from victims over the ramblings of a keyboard warrior. Anyday.

You have the police can do what they want attitude. No knock warrents cause innocent deaths that is wrong. When police kill a innocnet civilian in a no knock raid they have committed murder. If I did it it would be murder so the same should hold for the police. Police feel thay can get away with murder, that is wrong. Any police who feel this way, yourself included, should be looking for new jobs.

Suspects decide the level of force being used in any given situation.

False.

There have been hundreds of incidents where suspects, who were completely unarmed, were shot to death.

Over the course of millions and millions of interactions between the police and the public.

But that is not what you stated above...lol...

You said, "Suspects decide the level of force being used in any given situation"...

Again, your comment is inaccurate, not true and absolutely false.

Look, you obviously have NO idea about the law. You have NO idea what the legal definition of 'Murder' is, yet you throw the term around like water.

It's enough already.

I see we have attracted more nonsensical cop-hating ramblers to the thread. Have at it, boys.

That's my way of getting folks like you to reveal yourselves. Nitpick on side-issues or tripping over your gung ho's instead of recognizing and addressing the real problem.

No, you have piss poor attidue towards the people your are supposed to protect. If police had to live with only the proctions a civilian had this country would be better off. Many police like politicians like to get away with things just because of thier jobs and that is wrong, it hurts your relationship with the communities you serve.

“Truthfull” isn’t a word. Neither is “bunh”. Further, I didn’t answer your question, so you are just making an assumption. Finally, you apparently are unable to distinguish between inventing nonsense to attack the police, and a factual information that exists in a news story.

Here’s the deal. You don’t like the police. You decided to invent nonsense simply to attack the police. You got called on it, and now are desperately trying to screen that in a smokescreen.

Yet you'll accept collateral damage during military campaigns.

Some cops, like you, need to understand, you are NOT the military.

The 'wars' being fought in our streets are wars against criminals.

There is no *war* on the streets, there is no army against you on the streets...You need to learn the difference...In fact, right now in most major cities, crime is actually way down...

If I were you, I'd stop posting on the Internet suggesting there is a war going on, and you are somehow similar to the military....

Someone will eventually go to your superiors are request you be evaluated for mental issues.

Law enforcement officers should not think of themselves as the military or imply they are somehow like the military. That indicates a real problem with serious potential for excessive force claims and or justification for using excessive force.

If you think “ad hominem” refers only to “names” then you are truly more unintelligent than I first thought. Perhaps you should study what that term actually means?

Doesn’t say anything about identifying themselves...

Read the words immediately prior... Or are facts getting in the way of your agenda?

Are you a "sovereign"?

"respect" from "sovereigns" is hardly something I think he cares about.
