Three U.S. marshals shot in Elkins; assailant killed [one Marshal has died]

CHARLESTON, W.Va. — Three U.S. marshals were shot while trying to serve a warrant in Elkins this morning. The man who shot them was then killed by law enforcement, according to sources close to the investigation.

The marshals and State Police troopers were at the home of Charles Smith at about 8:30 a.m. to serve a warrant on him for failing to appear in court on possession of drugs and firearms charges, according to sources.

After announcing that they were there to serve a warrant, officers breached the door and stepped into the house.

Smith then opened fire with a shotgun, hitting one marshal in the neck, one in his bulletproof vest and one in the arm or hand, according to sources.

A marshal and trooper then fired at Smith, killing him, according to sources. The trooper likely fired the shot that killed him, sources say.

The marshal shot through the neck was transported to Ruby Memorial Hospital in Morgantown. His condition is unknown.

A statement from the U.S. Marshal’s office confirmed that three marshals were shot and that two were taken to a local hospital for treatment and one was transported by helicopter.

State Police spokesman Sgt. Michael Baylous could only confirm that there was a shooting incident in Elkins while officers attempted to serve a warrant.

Oh, geez, what a load. You think the cops and the judges who sign the warrants act within the confines of the constitution all the time?

Besides, this was a bench warrant for failure to appear at a prior hearing, probably an arraignment, not an arrest warrant.

What you should be asking yourself is WTH the feds were doing being involved in a simple possession of drugs and guns case in the first place. This was not manufacturing, growing or distributing, nor was it manufacturing of bombs, booby traps, anything like it. Just possession of drugs and guns. I don’t think the feds are needed for that. In fact, I’m not sure what the guy allegedly did should even be illegal, strange as that may seem to those of you who prefer the yoke of government.

Why are we paying three federal marshals, who rack down at least $150k each per year with benefits, to go serve a bench warrant? And send a state trooper along with them who actually does the work? Sounds like the feds were more of a liability than anything else.

Anyway, the whole thing is weird and does indeed smack of Ruby Ridge.

Looking at his MySpace page, the “shooter” looks like your average, red-neck, “from my cold, dead hands” country boy. He seems to have an affinity for the Confederate flag.

I wouldn’t be surprised to learn that country boys who like guns and the confederate flag are on Holder’s menu for the next two years.

Having been in LE for thirty years myself and pretty much seen it all, I have no particular reason to believe that these officers properly announced their warrant. They may have. They may not have. Flip a coin for your answer. Cops in general have no respect for individual freedoms nor constitutional rights nor private gun ownership. Often they precipitate what befalls them in warrant services or other planned operations through their own need to be top dog.

A “bench warrant” is an arrest warrant. As for your other “facts”, include the 150K nonsense... even if these Deputy Marshals were GS11s at Step 6, they’d only be making $58,667.

But hey, what is 100K mistake if we have an agenda to pursue!

Your reply reveals that you know very little of what you’re talking about.

A deputy U.S. Marshal makes in the $60k- $70k range (gs-11)within four years of appointment, a lot of overtime because they’re on call 24/7 but don’t get LEAP pay, get full medical and dental for themselves and their family members which is worth up to $30k per year, 24/7 use of a government vehicle and fuel because they are on duty 24/7, and pension contributions from the employer that will pay them 100% of salary after 25 years of service, starting at age 50.

LOL! Cite a specific provision of the Federal Rules of Criminal Procedure or a Specific Provision of the United States Code that says a "bench warrant" is not the same as an "arrest warrant" and that they hold "different weight."

I don't know what world you are living in, but you don't go from new hire to GS11 in 4 years. BWWAHAHAHAHHAHAHAHAHHAH!

You have to serve 1 year at the GS 5 level, then an additional year at the GS 7 level before you are eligible for GS9. Once you hit GS9, it takes 3 years to make GS11.

I find it laughable that you purport to know the number of overtime hours that these specific officers worked, and then add things in like healthcare and benefits to try to get close to your original outlandish claim of 150K, and even still, you fall way short.

Some go in at gs 7. Not all start as 5’s. Overtime for a deputy marshal usually runs about $15k per year or more. Besides, whether it takes 3 years or 4 years to get to gs 11, they get there pretty fast and stay there for all the many following years, or move into management. The use of a government vehicle and fuel is worth about $10k per year in out-of-pocket savings. They also have an almost-free, employer-provided life insurance policy that’s twice their annual salary. The health insurance plans they have are the finest in the world and would cost a family of five about $30k in the private sector for that level of coverage. The retirement plan they have is also unsurpassed and very costly.

You may quip that I have to add in things like healthcare to get to the original figure I stated, but these benefit packages are exactly what the entire country is in an uproar over. Once in awhile base pay is mentioned, but it’s the health care, overtime and pension costs that are the three biggest issues. They’re part of the salary - the overall compensation package paid to the employee.

I’m familiar with it because I’m close to somebody in that system.

If you don’t know the difference between a “bench” warrant and an “arrest” warrant, you shouldn’t be posting to me at all.

You are a complete fool, as others have noted.
