HOBBS -- A Hobbs man is shot dead after allegedly trying to break in to someone else's property.
The fatal shooting happened around 10:30 PM Tuesday. Hobbs Police say that Watson Green called them Tuesday night, saying that someone was breaking into his home in the 1100 block of North Denson.
Green, 70, told police that he had armed himself, but the dispatch officer told him to put the gun down and wait for police. Green decided to shoot the suspect through the door instead.
When police arrived, they found the suspect -- 43 year old Wallace Roberson -- lying in the alley next the home, wounded. Roberson was taken to Lea Regional Hospital, where he was pronounced dead.
The Lea County District Attorney is reviewing the case.
The shooting comes less than a week after an Odessa homeowner shot and killed a man who was trying to break into his truck. That homeowner has not been charged.

The current suspect (now dead) was out (apparently on bond) while awaiting a hearing on a previous burglary. For the homeowner, once burned, twice cautious. This should be an open and shut case for the DA's office.

That is extraordinarily wrong and stupid advice. You will always get caught and it will not look good if you go to court. Even if you manage to clear yourself of the homicide charge, you'll be done on obstruction of justice.

NM Constitution, Art II, Sec 6
NO LAW shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons. No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms. (As amended November 2, 1971 and November 2, 1986.)

I agree, he should have waited until the perp got inside the door (barely), then emptied the magazine (or revolver) into the sorry S.O.B.!
