Actually, it might or might not be fraud to apply as a foreign student: I have a nephew, born in the US, who is a dual US and Norwegian citizen. He grew up primarily in Norway (but spoke English at home). When he came to the US to look at colleges, he discussed his dual status openly and was advised by all of the schools to apply as a foreign student, especially since he would have the standard Norwegian government student stipend for Norwegians studying abroad. The only difference between him and other foreign students was that he didn't need any visa.
Of course, he wasn't asking for any financial aid on the US side....
