Posted on 03/29/2011 9:48:59 PM PDT by Anti-Christ is Hillary

FR is one of the smartest group of people I could think of to ask this question so all of you layers here it goes.

TOPICS: Crime/Corruption
KEYWORDS:
Why couldn't a group such as Landmark legal or a prosecutor either sue or bring Rico charges against not the unions but the bosses? ie the Trumka's?

I know it may be a stupid question so be gentle I'm not a layer just a questioner!!! Especially when EVERYONE knows that they are laundering money for Rat party.

I think because they are given specific exemptions from the law, via the federal government, for the private sector. But the states control the public sector, which is why Republicans are trying to take away their right to organize. Once that right is gone, they are at risk of being jailed if they organize.

I'm not a lawyer but if I'm mistaken there are plenty enough lawyers on FR to set us straight.

I haven't read anything on RICO in several years but if I remember correctly, RICO suits can be brought by private citizens against enterprises including nonprofits.

that’s funny...generally that would seem to be a marital asset - especially if you were a good one ;-)

It wouldn’t surprise me if there were a specific exemption from the RICO statute for unions. I know there is such an exemption to the Sherman Act.

The first issue that federal and state judges consider when issuing an formal opinion is what the result will be on society. On secondly do they consider what the law, constitutional or otherwise, says. Hence the joke they have made on the first ten amendments to the constitution. These amendments get in the way of the “modern” view of society. In light of this, challenging union power, the source of most of the money for the Democratic party, is not ever going to work until judges (many are obviously Democrats) believe that getting paychecks from the unions is bad. Good luck on this one!

BS

Republicans are not out to make union organizing illegal. They're stupid but not that stupid.

They're trying to reign in public sector unions because of cost and corruption. The corruption coming largely in the power unions hold over the democrats they finance so the dems do the unions bidding no matter how much it hurts the general public.

“Republicans are not out to make union organizing illegal. They’re stupid but not that stupid. “

I think in some states it does go to their right to organize, at the public sector. Wisconsin is just short of that...but effectively does the same thing.

And I wish they were THAT STUPID. This country DOES NOT need unions - unions served their purpose. We have laws through the teeth now, as well as ambulance chasers. Any business owner dumb enough to look at serious injuries and deaths as a just another line on the account ledger will be put out of business (or jailed) before he knew it.

No question that there has been conspiracy to commit felonies between this (illicit) administration and the Unions. However, the Fed Gummint is completely lawless at this point so it really doesn’t matter. Something will be done, or it won’t. Folks don’t seem to care. At least not enough of them.

"Right to Work" States PROVE that Unions are not really needed..
Unions exist there but they price themselves out of the FREE market..,br> Union work forces over bidding of contracts..

WHY?... any federal contract require the bid to be two or three times what it would normally be.. sometimes four times a normal contract/BID.. These bids to be paid by the taxpayer..

I agree absolutely that we don't need unions anymore. They did serve a good purpose at one time. Like when people had 3rd grade educations and went to work before puberty. Or they came over on the boat not speaking a word of English and were used and abused.

But we've come a long way in so many areas that even without unions people are not going back to the bad old days.

In the 21st century they do more harm than good on both macro and micro economic levels.
