Court Sets June Date To Hear Healthcare Appeal

(Reuters) - A court will hear oral arguments on June 8 in a government appeal of a federal judge's ruling that struck down President Barack Obama's landmark healthcare overhaul law as unconstitutional.

The 11th Circuit Court of Appeals in Atlanta said it would hear the appeal before a randomly selected three-judge panel. The fight over the law, Obama's signature domestic accomplishment, is expected to reach the Supreme Court.

Is the 11th circuit friendly? I would hate to think they would be judging this in the 9th.

Is the 11th circuit friendly?

The 11th is the court that first ruled on Bush/Gore back in 2000 and it seemed fair.

I don't know how much it has changed in the past ten plus years.

Any ruling from the judicial branch is irrelevant as they are not the final authority on the Constitution. That power is reserved to the fourth and most powerful branch of government, we the people. The judicial branch could change the Constitution at their whim if they were the final authority thereby contradicting the limited government principles the founding fathers instilled in the Constitution.

I have been before the 11th circuit in a class action bogus plaintiff claim involving residents of apartments)...court ruled in our favor (business owner). Seemed to be a business-friendly court that applied the law, not emotion.

This is for the Florida ruling, not the Virginia ruling.

That is also good, as the Florida ruling has more teeth.

Oral Argument Set for June 8

TALLAHASSEE—Today, the 11th Circuit Court of Appeals scheduled the health care lawsuit oral argument for June 8, moving the case one step closer to the U.S. Supreme Court. This expedited schedule paves the way for the challenge of the federal Patient Protection and Affordable Care Act to be heard before the U.S. Supreme Court by fall. While the motion for en banc, or full court, hearing was denied, scheduling the oral argument so quickly will ensure that the case continues to move forward expeditiously.
“We are pleased that the 11th Circuit scheduled oral argument this June, so we can resolve this case and protect Americans’ individual liberties,” stated Attorney General Pam Bondi. “This case will ultimately be decided by the U.S. Supreme Court, and a case of such national importance should have no delay.”

To date, a federal district judge has ruled that PPACA’s individual insurance mandate is unconstitutional and struck down the Act in its entirety. The challenge includes 26 states and the National Federation of Independent Business.

Why are they sending this all to the 9th Court? They think this will be the end of it? Not by a long shot. I would be for investigating the 9th Court. Maybe a little jail time.
