In a way - he’s right.

Lax DUI laws are indeed destroying life.

I just drove through there on a motorcycle. Yes, they have a speed limit and it seems to be observed at entrance/exit ramps.

Seriously, here in Minnesota we have .08% because that maximizes revenue. We have people with a dozen DUI's then finally kill someone before going to jail.

Raise the BAL to .15% and use a little common sense but for crying-out-loud, if someone is caught a second time they need to go to jail.

I disagree. I never, ever drink and drive. If I have one beer, somebody else gets my keys. But I’ve used one of those online BAC calculators to figure out how much it would take to get me over the limit. Five beers in two hours would put me at .07, still legal to drive. I know how I feel after five beers in two hours. There’s no way I, or anybody else should be behind the wheel at that level.

You’re all a bunch of jackasses. The alcohol limit is WAY TOO DAM LOW. There should be no penalties whatsoever until someone is .12 or higher, and it should be pretty minor until you hit .15

I propose a law to wrap barbwire around the ankles of folks that Jaywalk.

A lot of people get hit Jaywalking every year! You don't want to be against helping the children do you?

Stiffer punishments for repeat offenders!

That would seriously curtail revenue.

Correct.

Reduction in DUI deaths/accidents stopped declining at .13. Anything lower is revenue generation.

A close look at the legislative history will show that DUI limits below .13 were mostly led by pols trying to look tough on crime and to generate more revenue.

On the one hand, too many true drunks keep getting back in their motor vehicles and driving drunk. This needs to be addressed.

On the other hand, police have enforced DUI laws on people riding horses and bicycles. Do a FR search, the articles are out there.

On the gripping hand, if you get below .08 you might as well reenact prohibition. Below .13 you can get arrested for drinking orange juice.

but .08 is too low for the legal limit.

That is what I have long thought. You are giving police records to basically responsible people. MADD and greedy local governments went too far. Raise it back to 1.0.

BS!

either you’re lying or the machine wasn’t calibrated correctly. 3 beers in an hour put a 180lb man at .10 or higher.

Your logic overwhelms me.

But tell me - I seem to have lost the stats - how many people do Jaywalkers kill each year?

Yeah. Lock them up.

If the governments wanted to deter drunk drivers, they would sentence them to six months using an ignition interlock. It’s a breathalyzer hooked up to the car’s ignition. You have to hum into it to start your car, and every 30 minutes thereafter while driving. It records every action and the expense is borne by the driver.

Any violation results in revocation of bail and immediate jail.

There are certain issues where we just all feel we need to be “tough on crime.”

No concept of risk (magnitude x probability) and proportionality or consistency (fairness) apply. It's just like global warming, everyone knows they need to say “XYZ” on this topic. Then some Anne Frank story (the touchy feely teary eye story) is thrown around in case you do decide to think.

I have an idea. We should crucify those with a DWI on the side of the highway. Yeah, yeah, anyone have any more absurd ideas that show you're even tougher?

When you see a story about a drunk who caused mayhem, the BAC tends to be in the .15-.20 range. People arrested just at the limit don’t seem to have been causing trouble, other than running into an ambitious trooper.

Then they had us up against the wall
Hey it’s only blood grain alcohol
And there ain’t no cause for alarm
We ain’t out to do nobody no harm
How could anyone be so unkind
To arrest a man for drivin’ while blind

The Federal Government threatened to take away highway funding if Montana did not post a speed limit. Sooo, speed on all country roads is 70 mph during the day, 65 at night. Freeways are 75.

Montana is the least densely populated state in the lower 48, about the only thing that is hit on the highways are deer.
