Once the crime is out in public view, it shouldn't matter if the victim refuses to press charges
I believe that's how some (most?) states handle domestic violence cases.
Even if the victim doesn't want the perp arrested, the "state" becomes the complainant and off to jail they go.

That is correct. Another question comes to mind. If the defendant knew the victim was a transgender, why was she upset that he-she looked at her boyfriend? This goes to motivation. My bet is that she didn't know she was assaulting a transgender. Either way this case will be interesting to follow and to observe how the liberal media spins this.
