Obama’s ineligibility: Were Americans set up by the press and then scammed by the Congress?
Canada Free Press ^ | May 1, 2011 | Lawrence Sellin

So, in April 2008, it appears that a political deal was struck between the Democrats and Republicans that would provide cover for both McCain and Obama on the issue of eligibility. That would also explain the continuing conspiracy of silence by our political elite.

Because SR 511 has no force of law, Congress protected itself from legal consequences, but by political fiat they could do a “quick and dirty” amendment to the Constitution.

My fellow Americans – we’ve been had.

Yegads and little prairie dogs!!!!

Finally a piece that has the ring of truth. It would sure explain all of this eligibility nonsense with the MSM and the political elite.

You've been had. If I were an American after reading this today, I'd be some kind of P.O.'d

I’ve been pissed off since June 12, 2008 when that fraud in Our White House had his forged CertifiCATION of Live Birth posted on the Daily KOS. I became further disgusted at the GOP and the “end around” of Senate Resolution 511. It was passed by “Unanimous Consent”... I knew then we were fracked.

God Help Us, please.

I still want to know what all the “embarrassing” information some liberals told us would be on the long-form birth certificate that they didn't want Obama to reveal. Was it all just “pre-emptive” covering for him?

Your thinking was right. The father's citizenship is in no way irrelevant.

Huh??!!?/

McCain was also born on American soil - a US Naval hospital in Panama.

Not so!

John Sidney McCain III was born at the Colon Hospital, located at Avenida Melendez and 2nd Street, Manzanillo Island, City of Colon, Republic of Panama. The time of birth on the birth certificate issued by Panama Railroad Company (that owned the Colon Hospital) was 5:25 PM and the day and date of birth was Saturday, August 29, 1936.

John McCain's father, John S. McCain Jr., was a US Naval officer serving in the Panama Canal Zone. His mother was Roberta Wright. Both were American citizens.

McCain gets his citizenship via the Immigration and Nationality Act -- "by statute."

Sec. 301. [8 U.S.C. 1401] The following shall be nationals and citizens of the United States at birth:

(c) a person born outside of the United States and its outlying possessions of parents both of whom are citizens of the United States and one of whom has had a residence in the United States or one of its outlying possessions, prior to the birth of such person;

Sec. 303. [8 U.S.C. 1403] Persons born in the Canal Zone or the Republic of Panama on or after February 26, 1904

(b) Any person born in the Republic of Panama on or after February 26, 1904, and whether before or after the effective date of this Act, whose father or mother or both at the time of the birth of such person was or is a citizen of the United States employed by the Government of the United States or by the Panama Railroad Company, or its successor in title, is declared to be a citizen of the United States.

This case fails the test of jus soli -- NOT born in the USA
This case meets the test of jus sanguinis -- parents are US citizens
"At birth," this person was subject to the laws and jurisdiction of the United States and Panama, This person has "dual citizenship" via his birthplace. He is NOT a "natural born" citizen, and is NOT eligible to serve as Commander-in-Chief.

No, McCain is a natural-born citizen.

§ 217. Children born in the armies of the state.
For the same reasons also, children born out of the country, in the armies of the state, or in the house of its minister at a foreign court, are reputed born in the country; for a citizen who is absent with his family, on the service of the state, but still dependent on it, and subject to its jurisdiction, cannot be considered as having quitted its territory.
Law of Nations, Chapter XIX, Emmerich De Vattel

And federal law trumps Vattel.

is declared to be a citizen of the United States.

Notice it doesn't say WHICH type of citizen.

----

And federal law trumps Vattel.

No, it does not.

But when I say that, in free states, the law of nations is the law of the people; I mean that, as the law of nature, in other words, as the will of nature's God, it is indispensably binding upon the people, in whom the sovereign power resides; and who are, consequently, under the most sacred obligations to exercise that power, or to delegate it to such as will exercise it, in a manner agreeable to those rules and maxims, which the law of nature prescribes to every state, for the happiness of each, and for the happiness of all.
Of the Law of Nations, James Wilson, Lectures on Law

-----

There is a natural and a positive law of nations. By the former, every state, in its relations with other states, is bound to conduct itself with justice, good faith, and benevolence; and this application of the law of nature has been called by Vattel, the necessary law of nations, because nations are bound by the law of nature to observe it; and it is termed by others, the internal law of nations, because it is obligatory upon them in point of conscience.
James Kent, Commentaries

And you evidence for this is what, exactly?

I show you evidence from not one, but TWO eminently known and respected legal minds to prove my assertion and all you can do is tell me I'm wrong and call me 'silly'?

Dude....

that is just beyond pathetic.

What part of American law don’t you understand.

Vattel is not law.

American law is the law.

American law is the law.

And the Constitution is the blueprint for American law....and the Law of Nations is the operations manual for it.

If you had bothered to assimilate the quotes I posted (and sourced), you might have realized that James Wilson...who gave the lecture on the Law of Nations had a pretty impressive resume'.

Elected to the Continental Congress, 1775-77, 1785-87;
Member of the Constitutional Convention, 1784;
Associate Justice to the US. Supreme Court, 1789-1798.

I DO believe I will take a signer of the Constitution and a man who sat on the US Supreme Courts word over some one who thinks the very puerile statement - 'no It's not' is some kind of substantial debate.

-----

The Dude abides!

"The Dude" NEEDS to abide.....very, VERY, far away.

At least until he understands government was created to uphold the Law....not manufacture it.

the Law of Nations is the operations manual for it (the law).

But, the Law of Nations IS NOT U. S. LAW!

Do you even read your own posts.
