President Barack Obama has promised to make his administration the most transparent in American history. The push by the AP and other news organizations to make the bin Laden photos public could put that commitment to a key test. Ironic that AP is making such a statement.

In a letter to The Associated Press, the department said the AP did not demonstrate an urgent or compelling need for the photos or show that the information has a particular value that would be lost if not provided in an expedited manner. As a result, it is not clear when or if the photos will be provided. No urgent or compelling need? That's rich! Everybody likes to read newspapers that are several days old NOT!
The AP would not be in business very long if it had the policy that there is no urgent or compelling need for its information.

It could be that AP purposefully filed a request that did "not demonstrate an urgent or compelling need for the photos or show that the information has a particular value that would be lost if not provided in an expedited manner" in order to stall the photos from being shown.

Under FOIA, DoD has 20 days to respond to an initial request, and after that they are required to provide access to or quality reproductions of the requested documents in a timely fashion. That DoD is declaring that it will openly break the law will land Gates and company into federal court.
