GOP employs little used rule to block recess appointment of Warren

President Obama has used recess appointments in the past to get controversial nominees into the positions he chose for them. So the Republicans employed a little used legislative gambit to block the president's expected recess appointment of Elizabeth Warren to head up the new Consumer Finance Protection Board.

The Hill:

GOP opposition is preventing the Senate from completely adjourning for the Memorial Day recess. Instead, the chamber will come in for three pro-forma sessions over the next 10 days.

The cursory sessions are a formality that will ensure President Obama does not make recess appointments, a prospect that was considered unlikely anyway because the recess is scheduled for only a week.

Some Republicans feared that Obama would use the recess to appoint Elizabeth Warren to head the controversial Consumer Financial Protection Bureau, which will have broad powers over Wall Street.

BS! Total spin! The Democrats stayed in session during numerous recesses to prevent George Bush from making recess appointment. It had not been done before but the Dems started making sure there were no recesses that could be used for making appointments that would otherwise be problematical for the President.

That headline is an out and out lie and there's no way or no one to call them on it.

The trick was taken from the Democrats and is coming back to haunt them.

It’s about time someone showed some balls.

Republicans may take some heat for it, but they need to make sure they are loud and proud to have used this Democrat dirty trick.Throw it right back in their faces.

And lets not forget they are the ones who started using the filibuster to force a Supreme Court nominee to get 60 votes for confirmation. It all started back in the mid-90’s when they lost the House for the first time in half-a-century.

They have absolutely no honor whatsoever. They are beneath contempt, IMHO.

How does this affect his auto-pen signing of the Patriot Act extension? Is it a legal extension or not? It must be tested.

I don’t believe that the Auto Pen thing is a big deal. I believe that Bush also used it to sign something.

Yes, it is indeed good to see the Republicans with a backbone. I hope they decide it feels good and continue to do it. Democrats have been walking all over them for years, and they have done nothing in return. I am sure they will be condemned in the main stream press as partisan hacks, but that is to be taken as normal.

This doesn't effect the auto-pen signing. A congressmen, Tom Graves (R-GA) sent a letter to Obama asking for the legal justification for using the auto-pen to sign.

A freeper found a legal opinion from W's White House counsel office saying the auto-pen could be used. Of course, that's just the WH opinion, not a court's determination in the matter.

Since Obummer has no respect for the Constitution anyway, I wouldn’t put it past him to make the appointment anyway and dare the Senate to challenge him on it.
