Wuterich Trial Postponed Indefinitely (Haditha)
North County Times ^ | June 15, 2011 | Mark Walker

A manslaughter trial for the last defendant in the largest criminal prosecution arising out of the war in Iraq has been postponed indefinitely.

Camp Pendleton Staff Sgt. Frank Wuterich has pleaded not guilty to multiple counts of manslaughter and related offenses in the deaths of 24 Iraqi civilians in the city of Haditha in 2005.

The trial that was scheduled to start at Camp Pendleton this month has been delayed as a result of pre-trial wrangling over the removal of one of Wuterich's attorneys. No new trial date has been set.

If Wuterich had just been a cop in the Pima County Sherrif’s department SWAT team who executed Guerena he would have gotten off scott free!

So, what does THIS mean? ...does the poor guy have this hanging over his head...undeclared...postponed indefinitely. This article doesn’t SAY anything to let you know for sure what that means to him, or to the court system, or the future. Very poorly written. Ah, today’s media....blah.

Well damn it Marine! This news pisses me off to no end. Sargent Wuterich has been totally let down by our Military.
For a Marine that went through what he had to in Iraq, having to protect his squad in very dangerous areas to have gone through all the shit he has by the JAG etc., and not being given careful consideration by the last Marine Corps's Commandant as well as many others within the Marine and Navy establishment is beyond belief.
I have to split at this point. Other then saying, I can imagine my nephew a two tour Marine in Iraq, having to go through a similar scenario. Where he followed the ROE as well as protecting his fellow Marines. It saddens me to no end.

Postponed indefinitely?

INDEFINITELY??

Dear Lord, you have GOT to be kidding! Throw this stupid case OUT! This is ridiculous that he has to be left hanging like this for—what—six years!

This just makes my blood boil! Where is his right to a speedy trial? Grrrrrrr.

my guess is that this is political, as in the Iraquis want a sacrificial lamb and the tribunal knows he is not guilty

Yes, this report is woefully short on information. It's all but useless.

The trial...has been delayed as a result of pre-trial wrangling over the removal of one of Wuterich's attorneys...

That's been going on for what, a year now? That's nothing new. And it's not really "wrangling" - - everybody agrees on what happened. It's about somebody in charge making a decision. So make a decision already, judge. Every time I think this abomination of military "justice" can't get any more disgraceful, it does.

Indeed. This case should be thrown out for the sick, twisted joke it is.

Sadly, one Marine is the subject of political persecution, the other, tacit execution.

Regrettably, I no longer see commonality between LEOs and the Military. The former a device of Statism, the other, a force of Liberty. I’d like to think I’m exaggerating.

Something like that. It was a definite-maybe last Fall, no?

The silver lining may involve riding out the politics where it will eventually get thrown out. Prayers.

According to the article, he’s still serving. Good for him. I wonder if he intends to stay in...

Assuming the charges are dismissed, I too hope his investment in the Military works out.

On the other hand, we have Lt Col Chessani’s persecution:

Thanks for the ping, Lancey. SSgt Wuterich has been waiting a long time to be exhonerated. From an article back in Sept, 2010, Awaiting trial, Marine helped with training

Wuterich’s trial has been delayed for nearly two years by legal wrangling.

Wonder how much longer the military will string this along.

Think about now.

The American soldier or active-duty is now practically considered a domestic terrorist by Obama, Nappy, and Company while Muzzies are loved by them.

Do you really think SWAT would be used to mow down a mosque full of Muzzies? Not long ago a SWAT team or a group of police officers was about to raid a mosque here in America and the cops waited patiently and then took their shoes off before going in.

I’ve often wondered if a citizen could eventually appeal to the Supreme Court because of lack of due process over violation of “right to a speedy trial.”

We all know that Wuterich is innocent of any crime.

However, there comes a point in the prosecution’s inability to present a case where they have effectively admitted that they have no case.

I assume that at least one aspect of “the right to a speedy trial” is to prevent prosecution from making up and re-interpreting and shaping evidence due to distance in time from the actual events.

In the real Marines, Staff Sergeant Wuterich would have had a least two more looks at promotion by now. When he is finally exhonerated, he should be receive higher rank back pay for those lost years.
