Judge Blocks Indiana From Cutting Funds for Planned Parenthood Over Abortions

INDIANAPOLIS -- A federal judge on Friday blocked the parts of Indiana's tough new abortion law that cuts off most of Planned Parenthood's public funding in the state because the organization provides abortions.

U.S. District Judge Tanya Walton Pratt granted Planned Parenthood's request for an injunction in striking down the law's defunding provision as unconstitutional, and siding with federal Medicaid officials who have said states cannot disqualify Medicaid providers merely because they also offer abortions.

The U.S. Justice Department also had filed a brief siding with Planned Parenthood, with attorneys saying the law restricts Medicaid recipients' freedom to choose their health care provider.

We need to find the State Supremacy clause. Anyone know where it is in the Constitution? I am not a Legal Scholar.

we are headed for a judicial dictatorship. Even if conservatives get control of congress & WH, the ACLU types will challenge everything they do and activist liberal judges will prevent a conservative agenda from occurring, just like they did in AZ and now in IN.

Anybody have a solution?

You are looking for the Tenth Amendment which provides that the federales have only those powers SPECIFICALLY enumerated in the Constitution as powers of the central government and that all else are reserved to the states and the people respectively.

This is a trial court decision. Indiana will appeal to the Seventh Circuit where this decision will be reversed. The major danger would be if one of Sandra Day O'Kennedy or the conservative four on SCOTUS were to die or resign and Comrade O got to appoint an additional constitutional illiterate to SCOTUS making a five-member majority against the constitution. This is the danger when the justices and judges are not legal scholars but knee-jerk political hacks.

There's always the Nuclear Option:

Article III, Sec. 1

The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.

Congress has the power under the Constitution to dissolve the courts.

More importantly, Congress can determine the jurisdictional limits of federal courts. Congress can create a law that says “federal courts have no jurisdiction over cases involving abortion” (or same-sex marriage, etc.).
