An inconvenient Justice

It is dawning on the Left that their messiah is turning into a Pied Piper, and some among them are scared that a conservative successor to President Obama would appoint too many Supreme Court justices. Justice Ruth Bader Ginsburg is 78 and a colon and pancreatic cancer survivor, and as such, is just beginning to see opinions starting to be published to the effect that she should leave the bench now, so as to allow President Obama and the Democrat-led Senate confirm a left wing justice to replace her.

Erwin Chemerinsky, one of the brightest stars among left wing legal intellectuals and founding dean of the left-wing oriented UC Irvine Law School, for instance:

"She has in her power the ability to prevent a real shift in the balance of power on the court,"

Translation: "You're almost dead anyway. Just get out now so we can continue to rewrite the Constitution."

Ann Althouse highlighted this and other comments from the ghoulish ideologues who want the woman who never missed a day on the bench while going through chemo and radiation therapy twice to give up her place at the highest bench of all. Because their guy is so certain to lose. Or maybe just in case. Whatever. She should put aside her effort to live life to the fullest after beating the Big C. Twice.

I have never been an admirer of Justice Ginsburg's work, but every report I have read indicates she is a charming person, hard working, smart, and likable, good friends with at least one conservative colleague. I certainly admire the way she has battled colon, and then pancreatic cancer, and refused to give up on life. I suspect that she does not take it as a certainty that she will be dead in 5 or 6 years.

I wonder how a woman like this, so full of spirit, will react to this beginning of a bullying campaign to give up on her fight for her life and her work. Does she see herself as a member of a movement, willingly subjugating her own fate to the ultimate triumph of La causa? I suspect Justice Ginsberg is more of an academic liberal, her pathway as a law professor and ACLU general counsel being built on abstractions. Now that it is personal, I wonder if the underlying message bothers her?

I love it when the Left unmasks itself so unselfconsciously. They do not like human life very much. If it gets inconvenient, they have no hesitation to push aside individual lives in pursuit of the Great Cause.

It's right there for anyone to seem including Justice Ginsburg.

I don’t think I shock too easily. But I have been shocked to hear this sort of talk from the left. They want Ginsburg to retire so Obama can appoint a younger liberal/raical justice.

I even saw one article saying that Breyer should retire. He’s also getting up there in years, but hasn’t had the health problems of Ginsburg.

Is anyone else shocked that the liberals want older liberal justices to step aside, so that Obama can appoint young liberals before the 2012 election???????

Actually since the change in the Senate in the 2010 election, the Democrats have a small margin, 53 to 47. It’s possible that if Obama picked someone now who was very radical, that the 47 Republicans and a few more sane Democrats would block such an appointment. Plus the fact that if a vacancy happened now, Obama’s appointment would become a 2012 campaign issue since we’re only a year and four months away from election day. Obama might be reluctant to appoint someone who is too liberal.

Wish SOMEONE in the media would notice that what “They” are wanting here is completely un-American. Judges ensuring the ideological make up of the court is Tyranny.

Yes, it is shocking that leftists and Dems would blatantly come out and call for her to resign for this reason. Of course there's been quite a few shocking things happen since Zer0 took office.

I really doubt there are any in the Dem party now with the integrity to speak out against this. I fully believe there were some a decade or longer ago that would have and with the current president this will be encouraged by him.

Even if one of the justices unexpectedly dies or retires, which is always possible, I would hope that the Republican Senators can be persuaded to filibuster until Obama’s term is over.

The Democrats have repeatedly done that. The Republicans have simply GOT to do it now, too. And the Senate leadership has got to change its current ways and warn any RINOs who decide to vote for the next Wise Latina Obama nominates that they will be thrown off all of their committee assignments, lose most of their staffs, and be given a new office in the basement and a parking space on the roof.

Their kind of RINO treason has gone on far too long. The Wise Latina was completely unqualified, but she sailed right through, as did that lesbian loser from Harvard Law.

I couldn’t agree more.

The GOP has got to start playing hardball with RATS and especially RINOs. Confirming both those losers without so much as a fight was pathetic and those two are the caliber of any future Zer0 nominees to SCOTUS, God forbid he gets another chance at a nominee.

The inevitable end of the very legal theories Ginsburg so effectively espoused her entire judicial career: A complete disregard for the individual and human life.

In some ways this movement could well also backfire on the Liberals.

Appointment of Supreme Court Justices is one of the most significant acts to require participation of a Constitutional "President".

Having three or four Obama appointees on the Court should be viewed as a significant incentive for a Republican Administration taking office in 2013 to take legal action to establish that Obama was not a Constitutional officer and thus open the door to disqualify all of his Supreme Court appointments, permitting the Republican President to appointment a permanent Supreme Court majority.
