Corbett signs "Castle Doctrine”, several other bills (PA)

Information is from the PA Office of the Governor:

Harrisburg – Governor Tom Corbett today signed into law the following legislation:

Senate Bill 358: The bill amends the Act of June 24, 1931 (P.L. 1206, No. 331) known as The First Class Township Code by allowing electronic auctions for the sale of personal property belonging to a township. It also establishes related procedural requirements.

Senate Bill 360: The bill amends amend the Act of June 23, 1931 (P.L.932, No. 317) known as The Third Class City Code by allowing electronic auctions for the sale of personal property belonging to a city of the third class. It also establishes related procedural requirements.

Senate Bill 450: The legislation amends 30 Pa. C.S. (Fish), providing for terms of members of the Pennsylvania Fish and Boat Commission, to allow Fish and Boat Commissioners to serve on the Board for an unlimited amount of time after their eight-year term ends. This will allow the member to serve until a successor is appointed and qualified. Currently, a Fish and Boat Commissioner may only serve for a period of up to six months after his normal term ends or until a successor has been appointed and qualified, whichever comes first.

House Bill 40: The bill, known as the “Castle Doctrine” bill, amends 18 Pa.C.S. (Crimes and Offenses) and 42 Pa.C.S. (Judiciary and Judicial Procedure) to expand and further define an individual’s right to use deadly force inside or outside of the individual’s dwelling, residence, or occupied vehicle. It eliminates an individual’s duty to retreat before using deadly force if the person is in a place the person has a right to be and believes that deadly force is necessary to protect himself against death, serious bodily injury, kidnapping, or sexual intercourse compelled by force or threat.

Curious to be sure. But hey, if he can get more and more of “our” causes through without compromise to PA lefties; I’ll support it.

Remember the days, many long decades ago, when there was no need for a “castle doctrine” because it was understood as a right innately possessed, and criminals were known as criminals?

I never took Corbett to be a showboat like Fast Eddie. I see him do lots of things with little fanfare. He seems like he is no nonsense. Probably the reason he didn’t waste time with a big signing ceremony and just got the job done.

With reference to the Castle Doctrine bill, does it contain a provision whereby someone who has to use deadly force and does so, will he or she be protected from civil lawsuits by the person shot, or in the case of the expired, by his relatives?

That, I always thought, is a very important provision.

Actually, this would have never happened but for the PA legislature.

I have read not a peep from thr gov about hb40.
