Memorial pays $700,000 settlement to injured child of undocumented immigrant

City-owned Memorial Health System paid $700,000 to settle a lawsuit filed by an undocumented immigrant from Mexico whose baby allegedly suffered severe brain injuries during delivery four years ago.

Notice of the settlement, which was paid sometime in the April-June quarter, was contained in a quarterly legal report written by the Colorado Springs city attorney and provided to the city council.

An attorney for Maria Gallardo, who sued the city of Colorado Springs and the United States of America for medical malpractice last year, said the amount Memorial paid could have been a lot higher.

“The hospital settlement was only for the baby, not for the mother,” Springs attorney William Fischer said Wednesday. He said the mother's window of opportunity to file a claim on her own behalf under the Government Immunity Act had closed by the time she had filed. She has until her child's 18th birthday to file a claim on behalf of the baby, he said.

Memorial paid $25,000 for its deductible, and the rest of the settlement was paid by its insurer, Memorial spokesman Brian Newsome said.

The last two sentences of the article says it all:
Fischer said the baby’s father was deported to his native Mexico, though he said he did not know when.

“I think it was a weapons possession or something like that,” he said.

The family was her to fleece America/Americans - whether by social welfare programs or with a weapon.

I know a former OB-GYN in San Diego who quit after repeatedly having pregnant Mexican women arrive by taxi with no medical history, no pre-natal care, refusing to answer questions in English or Spanish, fully dilated, and with no insurance. If anything went wrong, somehow they women would suddenly know how to retain an American attorney and sue.

Illegal alien or not, that doctor and those nurses failed her baby. When my daughter (who is 4 months old) started showing signs of distress the very first thing they did was put me on oxygen and have me STOP pushing because they wanted to make sure she was ok. It turns out that the supplimental oxygen was enough to keep her happy, but if it wasn’t then a c-section was the next option on the table. Fetal distress is nothing to mess with.

This illegal almost certainly did not.

The settlement, while probably reasonable in light of the outragous Liberal bent in this country, is patently unfair against those of us who have to pay it.

Well, both I and my insurance company paid the bill. But what does it matter who paid the bill when someone is permenantly injured at the neglegent hands of another person? Go ahead and deport both of them back to Mexico, I have no issue with that — but this baby is a human being who will probably never develop cognitively beyond 6 months. The people involved do need to pay.

That’s right. Social Security Disability Income for the rest of her life which will equal millions. The local hospital in my town had 90% of its births to Hispanic parents last year and 87% of them were paid for by MediCal (Medicaid) meaning the taxpayers.

You think it’s right that our goodwill towards another, the free care in the first place, deserves to to slapped with a lawsuit?

DO you really think that if you stop to help another person along the side of the road, that they should be able to sue you to the extent that they never have to work again?

There in lies the real problem. This baby should not be a citizen and our hospitals should not be held liable for babies born of illegal immigrants who show up an the emergency room with no medical history or pre-natal care.

I really wish this issue would be examined. The baby was birthed here during the commission of a crime against our Federal government. To me, that should nullify citizenship.

If I rob my local 7- Eleven of all of its lottery tickets and one is a big winner, do I get to keep the money when I finish serving my time?

If we allow this "profit" which is derived from a crime, why not let other criminals profit from their crimes?

The only difference Moron is Lone Star Annie paid for her hospital stay and birth.
This person, didn’t pay for anything. Did you pay for yours or are you a leech too?

Just like a typical liberal- It is a right as long as it is paid for with other people’s money.
