This is complete garbage. It violates the basic principle of sovereign immunity (that office holders cannot be sued for their official acts).

A federal judge says former Defense Secretary Donald Rumsfeld can be sued personally for damages by a former U.S. military contractor who says he was tortured during nine months in prison in Iraq. I wish we could sue "judges" for them being such morons. Unfortunately, one of them would have to listen to the case so the good guys wouldn't stand a chance and we'd never win a case.
