If there is any place on this planet where DSK does not want to face a trial by Jury, it is in the Bronx.    Bronx juries are known for their very generous damages awards to  plaintiffs. It is a trial lawyers dream paradise and a defendant's nightmare.   If you have a strong stomach, read the Complaint:

Most Criminal law experts, especially the old timers say this definitely means DA Vance is planning on dropping the Criminal charges.   Of course, that means IMHO he will be former Manhattan DA Vance come next election time.

I’m having a hard time sympathizing with either. Given the make up of any Bronx jury, she is surely favored, but wouldn’t he have an appeal to a state court??? Seems if the prosecutors aren’t even sure they will file suit, her case is not that strong. And I “get” that that would be irrelevant to a Bronx jur.

TWO LEGAL OPINIONS ON DSK CIVIL SUIT:

Veteran defense lawyer Gerald Shargel, who’s not involved in the Strauss-Kahn case, said some lawyers delay filing a civil lawsuit to deprive the defense in a criminal trial from asking witnesses questions about the civil suit. But he added that he has found that the majority of lawyers file civil suits in sexual-assault cases before criminal trials.

“It may have some effect on the jury’s verdict, but it rarely decides the outcome,” he said.

An Annapolis, Md., defense lawyer who specializes in sexual abuse cases, Tom A. Pavlinic, said Diallo put her credibility at risk by bringing the civil lawsuit.

“She has done him a favor,” Pavlinic said. “Prosecutors, in my experience, don’t like when complainants in criminal cases initiate litigation in a civil case.”

The Manhattan district attorney’s office declined to comment on the filing of the lawsuit.
