Along with a motion to dismiss a lawsuit that alleges that the state's restriction on law-abiding citizens to carry a weapon outside of their homes violates the Second Amendment, Illinois Attorney General Lisa M. Madigan filed a response to the plaintiffs' request for a permanent or preliminary injunction. According to court documents filed on July 22, Madigan is asking the court to deny a summary ruling.

From the article:

In her argument, Madigan states, “Plaintiffs insist that they are seeking relief on behalf of ‘law abiding citizens.’ Any workable definition of that term includes all who have not yet been convicted of a crime. Every murderer, robber, and rapist fell within that definition at some point in their lives.”

In the twisted world of Madigan all citizens are presumed to be precriminals, therefore their right to carry arms must be eliminated.

Opposite this the Second Amendment:

A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed.

The writers of the Second Amendment assumed that the People of the United States were quite fit to own arms, use then properly, and police and punish the small minority that would abuse this right.

Nowadays that abusive minority lives primarily in the ghetto and goes by the name of Democratic Voters.

My brother works for this pint-sized socialist shrew. The entire office is as leftwing as it gets (including my brother) - totally dominated by Lisa’s daddy (speaker Mike) and other like-minded Chicago commies. I appreciate her rationale that no one should be allowed to carry guns because at some point in the future, they MIGHT become criminals.

Actually, the most abusive minority primarily operates in the halls of government.

There’s no hope for this woman. How could someone have graduated from law school and passed the bar and still not have even a rudimentary understanding of our Constitution.

Thank you for your insight. I hope that you will continue to post information as the case progresses. One of the wonderful things about freerepublic is the amazing ability to have people with local knowledge add to the discussion.

Lisa Madigan is a marinet, with daddy’s hands on the strings. Truth is (and even my brother concedes this) that even though Mike Madigan determines the big picture strategy, the AG’s office itself is a roiling mess of acid-like estrogen - very few men in leadership roles, and those who are, are neutered, appropriately survile lib dogs. HUGELY divisive in-fighting among the Mike Madigan thugs (whom he has planted throughout all levels of the AG’s office) and the formerly optimistic world savers like my brother. Having said all this, don’t be surprised if you see Lisa Madigan being stroked by the national media as presidential timber in the next six years.

I can't wait until she articulates that argument in front of the Judge.

Any claim that honoring the second amendment is against public interest is speculative and cannot form the basis for denying this constitutional right.

Right! By that rationale, none of us should be able to vote, because we might at some time in the future, commit felonies. None of us should have the right to free speech or to assemble, for that very same reason. This is the lefty mind at work, and which ultimately leads to scenarios like we see now in England, where a citizen is no longer able to defend himself against attack, lest the assailant be hurt. They get everything assbackwards - and deliberately so. Up is down, weakness is strength, etc. Orwell was so spot on it’s not even funny.

From the linked article: Stating repeatedly in the state's motion, which also relies heavily on precedence in English law, Madigan alleges that there is no "'core' right to possess firearms for self-defense outside the home [or] ... to carry firearms for personal defense in public places."

Did the state simply overlook Heller and McDonald? English common law can be used to understand the Second Amendment, but it can in no way be used to ignore it.

I guess if I lived in IL that I should shortly expect Tom Cruise to show up at my place...not such a stretch of the imagination.

Now I'm really depressed...first Obama, then Madigan, the twin ILL-annoy poxes on the body politic.
