Thank you for this thread. I don’t have sufficient time to follow the important issues of the day.

I happened to catch something a while back about some proposed federal legislation to regulate or license farmers’ use of rural roads to transport their crops. At the time that I read about it, it had been shelved because of opposition. I considered the story little more than a footnote and went on to other more important stories.

Seeing this story, and some of the comments by our fellow FReepers, gives me insight into Perry and his campaign that may have otherwise required a lot more research on my part.

Perry’s starting to look very good to me. Thanks again for your help.

THis is another time you’ve left off the date on the blog post you are posting. We already discussed this back on August 16th when it came out. It’s august 30th now.

It’s no secret that I can’t stand Perry, but unlike his supporters, when the other side has a point, I’m willing to acknowledge it (heck, I just got done arguing with a Perry supporter telling me that Islam is no threat to the West...since Perry had stepped in it on Islam)

Anyway, I was left with the same impression as Perry - the idea being that farmers would have to live like commercial drivers. So I don’t blame Perry here - but I have plenty of other issues to dispose of Perry with.

The Federal Motor Carrier Safety Administration - a federal agency - was apparently seriously considering this until it got so much blow-back it dropped the idea.

In fact, the FMCSA did not publish the notice withdrawing the request for comments on the idea until August 10, 2011, and Perry made his comments on a Sunday - August 14, 2011 - only 4 days after the publication of that withdrawal. Keeping in mind that these sorts of agency publications are routine and are generally made with little or no fanfare, it's not unreasonable that Perry would not have known about the withdrawal.

More to the point, however, is that Perry is not completely wrong - as the FMCSA notice itself states, farmers are generally subject to the federal commercial drivers license rules unless the state they're in decides to exempt them from those rules. Therefore, unless a particular state decides to exempt its farmers from the scope of the CDL rules, farmers in that state will be subject to a federal requirement that they obtain a CDL.

That's going to have really silly results for farmers who live at the border between two states if one has exempted them and the other has not.

That's a stupid idea all around, whether or not the states can exempt farmers.
