Thanks for that.

There was a prominent case some years back in MA where a woman who was being stalked killed the stalker when he broke into her home, and she got a stiff prison sentence.

Perhaps the law changed as part of the public outcry against her sentence.

I'll see if I can find the case.

the law is actually otherwise - see above- but I wouldn’t be surprised if this was the feeling of police and the AG - can you see an 82 year old veteran trying to “run” to a neighbor’s house to get away from two people half his age? - if this goes to trial, I certainly hope the jury has common sense - but this is Massachusetts.

I thought Massachusetts bacame a part of the United States after the Revolution, but they appear to still be a part of the UK.

Guess I should have seen that, BUT bottom line is, this elderly gentleman is to be commended for defending his property and life. It’s just not the happy ending that we’d have wished, i.e. perps exsanguinating thru .45 cal exit wounds.

No way. Its a complete myth that the south is gun friendly, same with the west. Ive lived in both places and Id take NH anyday esp now that the legislature has manned up and told the governor to pound sand. Even hippy infested VT would be a good choice relative to the liberal cesspool of MA.

I know, you can never jump thru enough hoops to satisfy the JBTs. Yet, they shoot at the least (or no) provocation. I think this guy stands a good chance of going free given a good lawyer. Being arrested is not the same as being convicted. So the cops have their heads up their rear ends, nothing new there. It would be easy to show there was no place for this guy to retreat.

As a resident of this filthy place I volunteer to be a juror. As far as I’m concerned the 82 year old deserves a medal not a jail sentence. Also he should be given a brand new M&P 45acp for his troubles.

You’re right - it was the law at one time based upon that Mass court decision - but thankfully, the Mass legislature had a moment of sanity (emphasis on “moment” :))and passed the law I cited after that case.

Most parts of the South are gun-friendly, but some aren’t. For example, here in North Carolina, the state requires anyone obtaining a handgun, by purchase, gift, or estate, to apply for a “pistol purchase permit” from the local county sheriff’s office. You fill out a form, pay a small fee, they give you the permit, you can then obtain the gun, and the permit is no longer needed and is not retained. Problem is, it’s not must-issue; county sheriffs have the final power to deny the permit, and considering I live in the most liberal county in the state, they make it as hard as possible to get one here. What’s worse, I also live in the only county in the state that requires handgun registration in addition to the clunky permitting process. It’s specifically forbidden by state law for a county or city to require registration...except for Durham County, which was grandfathered in when the law was passed in the 1930s.

You go next door to South Carolina and they’re much more laid-back about purchasing handguns...but last I checked, open carry is against state law, whereas here, it isn’t (though it’ll still probably get you detained when people see you packing and hyperventilate and call 911). Every state has its quirks and tricks with firearms laws.

:) I would say most of the south isn’t gun friendly. Any state that doesn’t restrict FA, sound suppressors, has easy (as in cheap w/ no hoops to jump thru) CCW, open carry, castle doctrine, police force that doesn’t hassle gun owners, etc doesn’t fit the gun friendly category. NC is a complete joke in regard to guns. NH OTOH is excellent on all counts. Even hippy infested VT scores high. In addition the NH legislature just overrode the sissy governors veto on a super self defense bill.

In the 90’s I was driving a cab nights, someone tried to rob me of my bank bag and I beat down the robber with my hands (black belt) and I was convicted of felonious assault. The most infuriating thing is, naive fool that I was, I reported the attempted robbery to the police, and they actually told me if I had kept my mouth shut the case would likely have gone nowhere.

According to the interpretation of this lib judge, if a person is capable of defending themselves they have enough control of the situation to effect an escape, and it was my civic duty to retreat.

As far as I’m concerned, I’m more equipped than the average bear to make abusers retreat and sometimes it’s a moral duty to make them do so. But now I know to keep my teeth together, afterwards. The justice system is an industry that needs both victims and criminals, and if you refuse to be a victim, you will be the criminal.
