Florida Forces Towns to Pull Local Laws Limiting Guns

MIAMI — The signs — “No Guns Allowed” — are being stripped from many Florida government buildings, libraries and airports. And local ordinances that bar people from shooting weapons in their yards, firing up into the air (think New Year’s Eve) or taking guns into parks are coming off the books.

The state has spoken, again, on the matter of guns, and this time it does not want to be ignored: since 1987, local governments in Florida have been banned from creating and enforcing their own gun ordinances. Few cities and counties paid attention, though, believing that places like Miami might need to be more restrictive than others, like rural Apalachicola, for example.

But this year the Legislature passed a new law that imposes fines on counties and municipalities that do not do away with and stop enforcing their own firearms and ammunition ordinances by Oct. 1. Mayors and council and commission members will risk a $5,000 fine and removal from office if they “knowingly and willfully violate” the law. Towns that enforce their ordinances risk a $100,000 fine.

Love my state here. Moved to Florida 5 years ago. We may have the best governor in the country, Rick Scott.

The fines should be paid straight to the gun-owner/carrier that is “inconvenienced”.

Not unless you can do it safely...and I can’t think of a way to do it safely, so it does remain illegal.

The fact that they revoked a town’s law against it does not mean that people can do it at will.

It is on the state level. Whar Florida is doing is knocking out local laws that are in conflict with state law.

I'm guessing there remains a state law for reckless endangerment or some other applicable statute(s) that would apply. This just gets eliminates the need for citizens of the state to have to learn a complete new set of laws and regulations every time they leave their hometown.

Certainly I'm not advocating randomly firing weapons into the air, but even that is probably, in the long run, less dangerous than allowing local governments to run slipshod over the state legislature.

Yet another reason that people from NY, NJ, MA, MD, and IL should NOT move to Florida. People have scary guns in Florida. Most people who live in the aforementioned police states know that only the police should have guns. SO< stay where you are and stay safe helpless.

DUH. I would only add to that . . . unless the person sticks his head over the muzzle before doing so.

That way he can celebrate and solve the problem of what to do with the moron at the same time. :)

Why would anyone want to? Fireworks are easy to obtain in this State, and MUCH cheaper than ammunition these days.

I agree, but there's nothing that would make doing so more dangerous in Miami than in Orlando, so this law, which just says the state is in charge of gun laws, can handle that just fine. There's probably still a statewide law in place about firing into the air.
