U.S. Environmental Protection Agency (EPA) has exercised its authority under the Clean Air Act to temporarily waive certain federal clean gasoline requirements for parts of Pennsylvania.

The waiver was granted by EPA in coordination with the Department of Energy (DOE), at the request of Pennsylvania Governor Tom Corbett.

EPA Administrator Lisa P. Jackson determined that...

Kinda like where executive orders replace the Congress, then Bureaucracies' organize to replace both the Cong and the Prez.

Stroke of the pen, we don need no steenking checks, balances, voters.

Dang, if Bush ever tried to do this, Waiver all over the place like the Obama Admin does, he would have been sued every hour of the day instead of every day of the week.

The EPA went on to ask the affected county's residents to help mitigate greenhouse emissions by restricting their respiration. Free plastic bags are available for those who have difficulty complying with this request.

If your district is purple, you get a waiver.

If your district is red, you get a lawsuit. Makes perfect sense.

I’d have to study the law to be sure, but I bet there’s a legal waiver process in it. In other words, Congress probably wanted the EPA to have discretion so that true hardship cases and emergencies could be dealt with. Nothing really prevents the executive branch from using such waivers to reward friends and punish foes. That’s a big problem. The laws were written for presidents who would use their powers judiciously, but as we’ve seen, the current administration uses them to punish political foes, even entire states (Texas), and it’s entirely legal.

opentalk: “This administration decides who wins and losses.”

Yes, and it’s probably entirely legal. It’s immoral to use waivers to reward friends and punish foes, but it’s probably entirely within the president’s legal powers to do so.

That’s why character DOES count, my FRiend.

wac, “isn’t PA a battleground state?”

For each of us, our state is a battle ground state. Take it to the people, or take it to the grave.

Thanks so much, Rab

Citi “Congress probably wanted the EPA to have discretion.”

Rab may be willing to also wager that EPA could care less about what the Cong wanted. Running for the moment sorta on what O team staggers around with.

O is losing it. Keep an eye on the prize. In the interim, let the folks eat cake.

Stroke of the pen…

Thanks for the comeback. Rab

The only hope is at the local level (cities, towns and counties).
