Asbestos abatement school owner sentenced BY MICHAEL P. TREMOGLIE

Ortiz A woman who was one of the Environmental Protection Agency's (EPA) "most wanted" fugitives was sentenced Sept. 13 to 87 months in prison followed by three years of supervised release.

She is the fifth environmental criminal captured since the EPA fugitive website was launched in December 2008, according to the announcement.

James Cattuso, a senior fellow at the Heritage Foundation, said he was was unaware of the fugitive list. He said he was amazed it existed.

"Certainly these are not violent crimes that would require wanted posters which is what they have here," Cattuso said. "I wonder if we need the EPA to be playing FBI?"

This freak sold thousands of certificates of completion to illegal aliens for asbestos abatement courses.

Illegal aliens, committing the crimes Americans don't want to commit, and their enablers helping them to do it.

In this case, the b(tch deserved jail time.

There is no Constitutional authority giving the EPA arrest powers, nor do I find any mention of the power to establish training requirements for “asbestos removal”.
This is a perfect example of out of control Federal Government.

Notice also that nothing will be done to the “thousands” of criminal illegal immigrants involved because of their skin color.

Once upon a time, we needed the EPA. Then, we passed laws to clean up the air and water and land and they were successful. But, the bureaucrats got scared and started inventing new forms of pollution and new ways to justify their expanding budgets. Now, it is a job-destroying leviathan with a “Most Wanted List”.

Every federal agency should be disbanded every 5-10 years and rechartered with its employees fired and the good ones rehired. If another agency thinks they can absorb the disbanded agencies duties, then they should be allowed to make their case and give it a try and let the old agency just die a quiet death. Basically, lets do BRAC with all federal agencies!

I always laugh at this asbestos nonsense, which has been a boon to lawyers.

I grew up in a prefab house that the government threw up at the end of WWII to house the soldiers coming home. The whole darn house was made of asbestos--from the roof, the insulation, the tiles on the floors--you name it. Even the wallboard was made of asbestos. My brothers and I, nor any of our neighbors that I ever heard of had asbestos poisoning. (Of course, we had a lot of air pollution in our area. We had chemical plants, oil refineries, and all sorts of stuff coming from the east, and from the west, we had a paper mill--which really smelled awful.) If my parents commented at all, they'd say it smelled like money to them--LOL1

I'm surprised at the reaction by FReepers on this thread.

She fraudently sold certs to illegal aliens. She undercut Americans, who paid for and had to pass their classes, by given certs to illegals who didn't attend the class for quick cash.

The EPA is an out-of control entity, but like a broken clock, they are right this time.

Doesn't anyone read the articles anymore?

Deleon is guilty of fraud and clearly merits a healthy jail term but do we want a “new” classification of environmental crime? Look what the designation of “hate crimes” has done for criminal justice. “Some pigs are more equal than others.”

I don’t know about you, but a broken clock that’s only right twice a day gets fixed or discarded in my house.

Besides the wholr cerfication scam needs overhauled too. The EPA mandates that you obtain a certification, but requires that you get it from an “approved” private vendor. There’s a lot of room for corruption in a system like that. This woman’s real crime (from the EPA’s point of view) is that she probably became too bold and obvious in her corruption and they had to bring her down before anyone noticed that the whole system is corrupt.

The EPA is a non elected body! they are allowed to run buckshot without impunity like most of the agencies tyed to this administration. Time is coming and I hope the new administartion come 2012 doesnot allow anyone who is in position now to stay on anywhere in any of these agencies. We need a complete purge of all agencies of this cancer.

Oh, not just a police force, but DOE has a S.W.A.T. (Special Weapons and Tactics). I'm sure the EPA has military-clothed, automatic weapon wielding, combat-booted thugs just for things like this.

By the way, my having to ask that question is a clear indication that we have too many alphabet agencies.

Twenty six letters in the alphabet and we already have to reuse them for different agencies.

The EPA is about as credible and the UN and has less respect. The only way they can get attention is to instill a sense of Nazi-like fear of their interference.

In then end, they wind up like their Nazi brethren.

She committed fraud. She deserves jail and fines. The points you're missing is that there is no Constitutional authority for a Federal licensing scheme in the first place, nor is there a Constitutional authorization for Federal police powers granted to all the made up bureaucracies.
DEA, EPA, DOE, ATF....
All of the alphabet agencies making their own regulations and then arresting people for violating them violates the separation of powers provisions.

I'm not an expert or a lawyer, but I can find no specific law passed by Congress mandating any licensing requirements for asbestos removal. The EPA hides behind “the clean air act” and “the toxic substances control act”, neither of which, as far as I've found, mention licensing asbestos removal.
