The definition of NBC was understood to be born of two citizen parents.

Use common sense. The requirement is there to help ensure that the president is loyal to the US and not some other country. Not many people remember their birth so it's not where a person is born but how they are raised that will shape their allegiance.

I guess you are ok with a communist spy sneaking in to reach US soil, drop a baby, take the baby back to said communist country, raise the baby as a hard core commie. Then at age 35 have him come to the US and run for president as a “progressive” !!

The part you are missing is that it was and has been understood that the DEFINITION of a NBC is a person born on the soil to two citizen and thus “LOYAL” parents. The baby is certain to be raised as an American. We did not have American Airlines back when the constitution was written. A child born here at that time clearly had parents that lived here as part of our culture and values.

That was certainly not the understanding circa 1780 via the first Naturalization Act.

That law held that a child born of a US citizen father (one parent) born overseas would be a natural born citizen of these United States.

You also, in your hypothetical example, forgot the residency requirement. Being a natural born citizen is necessary, but not sufficient, to being qualified for the Presidency.

I don't think he is. He was born in the U.S. to parents who were resident in the U.S. and later became citizens. OTOH, is this the year when the Dems would want to push this subject? I don't think so.

There are two kinds of citizens in this country: NATIVE born (by birth) and naturalized (by statute).

“Natural Born” is a native born citizen who had two citizen parents when they were born and is eligible to be president. The rest are not.

Ok, so the commie comes back to the US at age 26 and runs for president at age 35.

Yes it was just a hypothetical but adding the meeting of the residency requirement as you pointed out would make this hypothetical both possible and legal according to those arguing parents don't matter. I think people like myself go with the spirit of the constitution and don't want to argue what the meaning of is is. Clearly the founders were trying to mandate the president meet certain requirements to guarantee loyalty to the US. Given that the two hypothetical scenarios would be entirely possible for those arguing the other side is evidence that their position is NOT in alignment with the spirit of the Constitution and the forethought of the founders. Clearly parents as well as birthplace matter. How could those arguing the other side accept a person that does not speak a word of English and knows little to nothing about American culture be eligible for President. If you can explain that you might convince me.

That isn't what the law says currently.

What it should say, or what the founders intended by it, is an entirely different question. But so far, neither Federal statute nor court decision establishes that there are citizens who are "native-born" (born in US territory, of parents who are not agents of a foreign state) but not "natural-born" (eligible to be President).

You failed to address that the understanding of the term “natural born citizen” circa 1780 included a child born overseas to a US citizen father.

Clearly they did not understand the meaning of “natural born citizen” to only include those born in the USA of citizen parents.

I am NOT arguing that “parents don’t matter”. Clearly under US law, to be a citizen at birth (and thus a natural born citizen) parents DO matter.

McCain, for example, was a citizen at birth (and thus a natural born citizen) due to who his parents were, so clearly I am not arguing that “parents don’t matter”.

If there can be a successfully nomination of an eligible person who doesn’t speak a word of English and knows little or nothing about American culture - then the American electorate is in trouble beyond the power of any obscure and self serving interpretation of any clause in the Constitution to rescue.

No, Rubio good guy that he is is not elibible to be VP or POTUS. It would be a big mistake to try to run him and I think he knows he’s not elibible and has enough integrity to refrain from running.

Just because we let one cat slip through the door does not mean we should let it happen again. In fact we need to make sure this mistake sitting in the White House is never allowed to happen again.

NO!!! Just the VATTLE Birthers. The other people who are or were Birthers weren’t idiots or liars. Don’t confuse common sense suspicious Birthers, who were not sure where Obama was born, with the Vattle Birthers.
