Feds ask court to dismiss ’don’t ask’ lawsuit

Even as federal officials laud the end of the U.S. military’s ban on openly gay troops, Justice Department lawyers are trying to dissuade a federal appeals court from deciding if the "don’t ask, don’t tell" policy was unconstitutional.

They filed a motion Tuesday asking the 9th U.S. Circuit Court of Appeals in San Francisco to vacate a lower court ruling last September that found the ban violated the civil rights of gay service members.

The gay political group Log Cabin Republicans, which brought the case, wants the appeals court to address the ban’s constitutional implications.

Hmm, tell me if this has an upside. I don’t get it. Very disheartened today.

The activists have a serious, powerful interest in getting the court to "find" DADT unconstitutional, even though it was "repealed." They know that this law is easily reversible by a later conservative congress and president to the pre-DADT days of banning all homosexual behavior among service members if a federal court doesn't weigh in to pre-empt a future reversal.

I expect the court to continue attacking it. Attacking American values is what they're all about.

Of course they want it dismissed. They are terrified the courts will say it is constitutional.

Thanks for explaining it. I’ll ping it now that I see what it means.

May that day of reversal come SOON!

Massmike explained what this means since I didn't get it. The Log Cabin homosexual activists want "DADT" to be found unconsitutional so reversing homosexuals in the military will be hard for future presidents and Congresses. I can't wait for the reveersal.

The court should dismiss the case as moot. Whether they will or not, who knows.

I missed the story about the boy in his German class.

I don’t disagree with you in general, but lack of a protected class regarding homosexuality is not enough. It must be legal to discriminated against them. There have to be Rs with courage and moral compass who go back to before DADT. DADT was bad enough.
