An illegal immigrant has been sentenced to 11 months in jail with work release for causing a traffic crash by drunken driving in the wrong direction on I-43.
The sentence outraged Milwaukee County Sheriff David A. Clarke Jr., who asked his staff to contact the U.S. Bureau of Immigration and Customs Enforcement to urge them to deport the man.
"Why would we let an illegal immigrant out on work release to look for a job he's not supposed to have? He's in the country illegally," Clarke said in a news release. "As soon as he's released for Huber, he's going to flee. He knows he's facing deportation at the end of his sentence. He's a flight risk."
Armando Rodriguez-Benitez, 35, drove with more than three times the legal limit of alcohol in the wrong direction in the southbound lanes of I-43 from Becher St. on July 21 until he was stopped by a sheriff's deputy on the freeway near Capitol Drive, officials said. To avoid a head-on collision at Burleigh, another vehicle was forced to crash into the median wall. Rodriguez-Benitez crashed into a car near Keefe Ave.
According to online court records, Milwaukee County Circuit Judge Jeffrey Wagner sentenced Rodriguez-Benitez Wednesday to 11 months at the county jail with Huber work release privileges. He faced up to 10 years in prison on the charge and should have been deported immediately, the sheriff said.
"If the judge didn't find this incident serious enough to send him to prison for an extended period of time, then an 11-month bed-and-breakfast stay at the county jail is a waste of taxpayer resources," he said. "The deportation process should start today, not 11 months from now. The county property taxpayers should not have to pay to house him. If all we are going to do is give him a slap on the wrist, then let's just start the deportation process."
He said that his staff has contacted the federal government to make them aware of the work-release sentence and urge that they immediately begin the deportation process.
Clarke said Rodriguez-Benitez was also cited for several serious violations, which were dismissed, including driving the wrong way on the highway, reckless driving, driving without insurance and driving without a license.
The judge stayed a prison sentence of 4.5 years, confinement of 30 months and extended supervision for two years.

An illegal immigrant was recently sentenced in connection to a Milwaukee car crash that claimed the life of a 34-year-old mother. According to a Fox 6 Now report, in connection to the fatal accident the man will serve 15 years in prison and seven years of supervision. Since he is also an illegal immigrant it will be up to federal officials on whether or not the man should be deported after he completes his sentencing.
According to prosecutors who tried the case, on New Year's Day the man had driven a vehicle into three separate cars before colliding head-on into a vehicle being driven by the 34-year-old. At the time, his blood alcohol content was reported to be twice the legal limit. In Wisconsin the legal driving limit is .08.................................
The first accident involves two fatalities, and took place early Sunday morning near 12th and Rogers St. on Milwaukee's south side. Milwaukee police say they've arrested an 18-year-old illegal immigrant.
The second crash involves a car allegedly heading the wrong way on I-43/894, before hitting an SUV. The SUV driver walked away from the crash, but the car's passenger was seriously injured. It's driver admitted to being in the US illegally.......................................
Jorge Dominguez is now on an immigration hold for homicide, driving with a suspended license, and multiple previous charges throughout southeastern Wisconsin. US Immigration Customs Enforcement (ICE) confirms that Dominguez is in the country illegally, although this conclusion was not reached until after a fatal accident Monday night.
Dominguez ran a stop sign and t-boned the Glogovsky family's Chevy before fleeing the scene on foot. The hit and run critically injured Dawn Glogovsky who later died at St. Catherine's Hospital where the two other passengers were also taken for injuries.
Dominguez was in jail May of last year when he was put on an immigration hold, but it was lifted by the time he reappeared in August at the Racine County jail.
The judge should be held up to area-wide ridicule for such a ridiculous sentence. THREE times the legal limit. Driving the WRONG way on the Freeway. Illegal imigrant. Geesh! Sheriff David Clarke is a municpal jewel. God love him.
That is a bad idea as it effectively gives him a get out of jail free card simply because of his illegal status. A deportation is largely meaningless and he would be back in a matter of days, having not served any of his sentence.
Brand him and deport him. He would be easily found right away to be deported again.
