That's my interpretation of events. Some one dug this story up from old records and handed it to Politico--or Politico dug it up themselves--and then in investigating the issue, they managed to unearth the identities of the women (allegedly). Since Cain has said nothing happened whatsoever, these women are seeking to respond to that dismissal.

It doesn't appear to me that these women initiated anything. It appears that they only want to clear the record from their side, but I would say that since their names have not come up and nobody but the NRA, Politico, and presumably Herman Cain knows who they are, they are getting bad advice from a lawyer looking to make some money.

I'm not sure you can reasonably construe Cain's denying anything happened to be either breaking the confidentiality agreement, or to be casting aspersions against the two women.

Well, Cain did say that he was falsely accused, which by implication means the women made false charges against him (they were lying). It depends on the language of the contract, but that could come back to bite him. Not saying I agree with the charges, just legal theory stuff.
