A PEDOPHILE who broke into a Brisbane family's home, stripped naked and molested a three-year-old girl and took indecent photographs of the toddler as she slept has received a combined jail term of effectively eight years.
The Brisbane District Court was told Craig Anthony Ellis broke into the family's Aspley home on Brisbane's northside and sexually assaulted the toddler on January 21, 2009.
Ellis, then aged 29, tried to flee when the girl's parents were awoken by their daughter's muffled cries - resulting in the toddler's father crash tackling the naked intruder while the mother struck the pedophile with an ornamental samurai sword.
Judge Michael Rackemann said Ellis' behaviour and abuse of the girl was "very disturbing" and warranted an eight-year term. During today's hearing Ellis threatened to kill the judge, the prosecutor, his child victim and her mother
However, the judge said because Ellis had already been behind bars on remand for two years and nine months, a sentence of five years and three-months was appropriate under the circumstances.

Private gun ownership is not banned in Australia. There are over a million gun owners and at least a few million guns in private hands.
We do have some stupid restrictions to live with, but it’s nowhere near a ban.
As one example, I own a semi-automatic assault rifle, a couple of handguns, and a bunch of .22 rifles myself. All totally legal.

The child will bear the scars for life, she will forever be sexually crippled, the family will suffer for life, the perp should get the death sentence, or at a minimum be castrated, not walk after three hots and a cot for five years.

There’s always the possibility that some kind guard (who is also a parent) “accidentally” puts him out in the general population, amongst bank robbers, thieves and drug dealers who, despite their own sins, also have kids and don’t want this animal anywhere near them.
He’d better say his prayers. He might not even have five years to live.

Why such little time, is that common? And no additional time for threatening to kill the judge and Childs family?
The sentence is a joke, hopefully a decent convict will beat him to death with a mop handle.
Under Australian law, if you believe you, or another person, is in danger of death or serious injury, you can do anything and use anything to defend yourself - including a gun. We do have a right to self defence guaranteed in common law and that is what it says. It's true that most people cannot get a licence issued simply by saying they want a handgun for self defence - that by itself is not sufficient reason - but if you have one issued for another reason, you can certainly use it in that way. The simplest reason for most people is to be a member of a gun club.

The 'right to carry' is a peculiar provision of American law and doesn't have any analogue in Australia because it doesn't really have any relevance in Australia - that is, we haven't had the same legal history you've had, laws and court decisions here have gone differently. If a person is licenced to own a firearm, simply by virtue of that fact, they can take that firearm into most places unless the place is expressly excluded or their licence is specifically restricted. It's never needed to be stated in terms of a right to carry, any more than you need a 'right to drive' on public or private roads, if you have a driver's licence. It's part and parcel of the licence. Some people do have more restricted licences. Plenty of people don't - though it does take some effort to get such a licence. Long arms are actually more complicated because there are legal precedents that make carrying an obvious weapon around a 'breach of the peace' in quite a few cases.
I don't carry a handgun often, but when I do, there's very few places I can't carry it (Courts, and certain other government buildings, mostly).
Yeah, by the time you get it out of the safe, assemble it and find the ammunition it’s too late.

Unfortunately such sentences like this aren’t uncommon in Australian courts. Generally the officially available penalty is much higher (my guess is 20 years on these types of charges) but Judges have to consider a prisoner’s record, what other sentences have been imposed, etc, and very few get anywhere near the maximum. 8 years for this type of crime, isn’t an uncommon sentence.
People blames the Judges, but it’s often not their fault - they have to follow the guidelines. If they are ‘too harsh’ according to the guidelines, they can open avenues for appeal.
Don’t need to assemble it, but do need to have it locked up and ammunition locked up separately.
I can be armed in less than 30 seconds from waking up. Is that too long? Yes, I think so. But it’s still a long way from a ban.
I have stopped burglars in my home twice quite successfully. Only once with a weapon - the first time I actually forgot I had weapons, I was so shocked and stunned.
So in about 5 years he’ll do this to another child. Sad.
