I agree. It’s the establishment vs the people and not enough people care about the fight.

I certainly wouldn't count on Scalia:

...the authority to enact laws necessary and proper for the regulation of interstate commerce is not limited to laws governing intrastate activities that substantially affect interstate commerce. Where necessary to make a regulation of interstate commerce effective, Congress may regulate even those intrastate activities that do not themselves substantially affect interstate commerce.

J. Scalia, concurring in Raich

“So the Government can now force you to eat broccoli or drive a Chevy.”

Yep. All they have to do apparently is suggest the existence of some sort of national problem, and claim that broccoli or a Chevy is the solution. And if you can’t afford it or don’t want it too bad. Apparently these judges see very little constitutional limitation on what Congress can do.

I don't trust the GOP to do a damned thing if they win big next year, even with a GOP president.

I don't think the American experiment is going to last much longer. The cancer of the progressives/marxist has gotten to the point where we cannot remove it without killing the patient. Also, we can't continue to go on where every key decision is decided by a 5-4 vote in SCOTUS.

What good is a law if they can't enforce it.

I will NOT submit to this kind of tyranny. I WILL decide what is best for me and my family without government healthcare.

I WILL defend it with my 2nd amendment right. Darken my door step and find out!

Panel of.3 or en banc?

I heard this morning that it was 2-1.

In the 11th Circuit case where the 3 judge panel struck down the individual mandate, the dissenting judge was also a Reagan appointee.
And one of the two in the majority was a Clinton appointee.
The good news is that Kennedy has been fairly good (not always like Thomas) on commerce clause and 10th Amendment issues.
We have a shot.

I don't think this case dealt with the biggest Constitutional problem with zerocare.
They didn't address and weren't confronted with the commerce clause aspect of the law. I think the complaint (which I sympathize with of course) had to do with the intrusiveness of the law regarding religious beliefs, etc.
Our best chance is on the case out of the 11th Circuit.
We can win it. A Clinton appointee voted to strike down the mandate.

the people are still in charge no matter how bleak the outcome seems... eventually all of the oligarchs will answer to the people... if we get angry enough.
