What is the down side to him quitting? I assume an appointee by Hussein would have to be approved by the Senate, and I am assuming the Senate has enough Republicans to block Hussein.

Unless he made another recess appointment like he did with the last appointee. Nonetheless, I like this guy's thinking. I hope he does it.

Well he has a Nov. 30th deadline - not much time. Even so I’d have a strategy meet with House and/or Senate GOP leaders to at least coordinate and see if they’ll block recess appointments.

Just like Scott Brown was the "supposed spoiler" to Obamacare, Harry Reid will find some obscure rule - or better yet change the Senate rules - so as to skirt that requirement. Reid has talked about changing the filibuster rule for sometime now. Reid triggers ‘nuclear option’ to change Senate rules, end repeat filibusters

Don’t just hamstring the Labor Board, eliminate it after elimiting the EPA, Education, Energy, and Homeland Security and firing everyone that works for them!
