Congressional officials said President Obama has used his recess appointment powers Wednesday to name a head for the controversial new Consumer Financial Protection Bureau in a move Republican lawmakers said amounted to an unconstitutional power grab.
Mr. Obama made the appointment of former Ohio Attorney General Richard Cordray even though the Senate, which has the power to confirm nominees, considers itself still in session.
But the White House argues Republican senators stonewalled the nominee for so long that Mr. Obama had no choice but to circumvent them.
In making the appointment, Mr. Obama rejected the precedent set by former President Clinton and the precedent Mr. Obama and his fellow Democrats set under President George W. Bush in 2007 and 2008.
Although the Senate is not in recess, President Obama, in an unprecedented move, has arrogantly circumvented the American people, said Senate Minority Leader Mitch McConnell, Kentucky Republican.
GOP House Speaker John A. Boehner called the move an extraordinary and entirely unprecedented power grab by President Obama that defies centuries of practice and the legal advice of his own Justice Department. The precedent that would be set by this cavalier action would have a devastating effect on the checks and balances that are enshrined in our Constitution, the Ohio Republican said in a statement.

Obama is a criminal. Nothing new. This is typical of how he bypasses the Congress. Our real problem is that we do not have a strong, pro-Constitution Congress....otherwise Obama would have been history a long time ago.
Boehner can talk the talk but let's see if he can walk the walk. All he has to do is cut off funding for this Consumer Protection Bureau. We'll see if all these bureaucrats will work for free!
This means a Supreme Court vacancy can be filled, without the Consent of Congress, doesn't it?
This is now a Dictatorship, using Executive Orders, un-elected Czars, and Regulatory Agencies to make Congress un-necessary.
How there is not ONE Republican that would challenge the Constitutionality of all this is beyond reproachable; it's Treason, pure and simple.
It’s bigger than that because they aren’t in recess. Even the White House doesn’t claim it’s a recess appointment, they’re doing it because they say the GOP is obstructionist.
By law they can’t do it, but they are anyway because the GOP doesn’t have the cajones to defund and get rid of the department. This is a Constitutional crisis pure and simple.

There has to be repercussions for this. Why does Brack and his fellow outlaws feel that he cant be stopped? It’s because he hasn’t been stopped yet. Now’s the time to take a stand!

And to think, Obama may very well be given another 4 years to play dictator.

Any US senator can now sue Obama in federal court, and win, and though since Marbury v. Madison (1810), the president cannot be compelled to personally obey court decisions, and often don’t, his appointee would be stripped of any and all powers given to him by Obama.
In effect, he could give no legal order, make no regulation, or do much of anything with the force of government behind him. As well, any of his subordinates would be in the same position. Any order attributed to him would be automatically null and void.
Does Congress matter any longer? Seems to me that Obama just does what he wants.

If they made a promotion of someone covered by civil service rules, rescind the promotion and demand a return of the additional pay, else prosecute them as well.
Every illegal act can be undone and his henchmen prosecuted for return of the money, or whatever.

That makes it OK for the People's Militia to be called to duty by the House of Representatives ~ and authorizes Boehner to INCARCERATE the Democrat members indefinitely.
We can actually start rounding up Democrats and putting them in impromptu prison camps for the winter.

But - all funding must be allocated by the House. Defund the bureau.
That's actually the best way because you don't have to go to war ~ and it's a lesson that'll last a very long time.
The second thing you do is react now and begin doing what you need to do to remove him. Sometimes he's smart, and like Nixon, will back down. Sometimes he's a total idiot ~ like Obama ~ and it's entirely possible armed force will be required. Even there we have choices. Just calling up the militia might encourage people to counsel him to reconsider his stupidity. Shooting a few Democrat Congressmen right on the floor of the House would be encouragement to better behavior (presuming the Sergeant at Arms knows how to do that ~ it's part of his job).
Use of thermonuclear weapons would be a last ditch item and best done in some one else's country.
Frankly, I think the nominee for this job is going to LEAVE TOWN SOON and we'll never see him again. Last thing anyone ever wants to do is become known personally as a cause of war ~ e.g. War of Jenkins Ear is one such instance.
The prospect of downstream lawsuits designed to strip him to his underwear might well be enough to bring this whole thing to a close. The other staff people ought to start thinking about that too ~ sure, times are tough, but would anybody want to be around in an federal agency a revitalized Congress next January wants to dismantle, and where there are members looking to PUNISH THE STAFF.

I noticed at the very bottom of the article that Reid isn’t going to fight it. Guess if he wants to give up his own power and screw himself then I hope he doesn’t complain when it comes back to bite him later.
