Obama bypasses Senate, installs new consumer chief
Associated Press ^ | 1-4-12 | BEN FELLER and JIM KUHNHENN

President Barack Obama says he won't take "no" as an answer from Republicans, so he's going around them to appoint the head of a new consumer protection agency. Obama says Republicans would just keep holding Richard Cordray's nomination hostage—and the president says that's inexcusable and wrong.

He says Cordray must be in place in order for the Consumer Financial Protection Bureau to start helping consumers deal with unscrupulous mortgage companies, dishonest payday lenders, and others.

Obama announced the appointment of Cordray during a stop Wednesday in Ohio, where Cordray once served as attorney general.

Republicans are outraged but Obama says he has an obligation to act when Congress refuses to.

The recess appointment means Cordray stands to serve for at least the next two years.

Obama is just setting precedent for when the Republicans take control. If the next Republican President does something the MSM doesn't like, he can just site the "Obama Rule."

Also, since Harry Reid invoked the "nuclear option" earlier this year, no one can raise a stink when the Republican-controlled Senate does it next year. Its no longer the "Nuclear Option," its the "Reid Option."

“Power of the purse. No money, no agency. The Kenyan lizard cannot spend money not allocated by congress.”

Who’s gonna stop him?
We no longer operate the government on “Budgets”, just continuing resolutions.

We haven’t had a budget since 2009.

How can you defund the entire department this fiscal year? The Omnibus spending bill has already been passed by Congress and signed by Obama. Moreover, the Reps only control the House. How would you get a defunding bill thru Congress.

I thought a recess appointment was only good until the end of the current Congress which is the first week of January 2013? Or has Obama fudged that as well?

A second term of this would be the end. He cannot do this without enablers. Just like DOE loans, DOMA, fast and furious, vetting...

The senate convened for a Pro Forma session yesterday and will do so again on Friday. This is how Harry Reid blocked Recess Appointments by Bush.

Obama’s getting in practice for how he intends to rule following his re-election in November. What separation of powers?

This reminds me of Hitler's rise to power. He just took it when the opportunity arrived and the timid opposition caved in and let him do what had decided to do. We are flirting with the same sort of takeover here.

The GOP is rapidly becoming not only the Stupid Party but also the Cowardly Party!

The GOP will huff and puff, fold their tents and slink away in the dark. It’s what they do.

Obama’s move isn’t even valid under the statute creating the CFPB: The law apparently states that the Director must be confirmed by the Senate and not appointed to trigger empowerment:

“Sources tell Capitol Confidential that the statute creating the CFPB demands that the director be confirmed by the Senate—not installed via recess appointment—to trigger the agency’s shift from Treasury to the Fed and empower the Director.

The Senate does not control funding. The House does.

If anyone tries to oppose Obama he will use his new power to declare them a terrorist, lock them up and throw away the key. Checkmate.

Republicans are outraged

But not so outraged as to vote a Bill of Impeachment.

And that's the problem, isn't it.

They ought to start Impeachment proceedings, but we know that wouldn't be successful, and would all but guarantee that Obama wins reelection.

I wonder who would have standing to take this to (ultimately) the Supreme Court? Hopefully, that institution isn't yet so corrupt that it would ignore such a blatant violation of the Constitution. Obama won't get much use out of the issue if it's him versus the Supreme Court.

An alternate strategy would be for Republican senators to block all senate business.

The lizard can be made to look like Hugo. This is a good fight.
