The question I have is “what is the law?”

Maybe I have a major misunderstanding but, where is it granted that the President can decide to enforce or not enforce (grant waivers) to laws that have been passed by the legislature and signed into law? Not that I agree with this damn law... I don't. I just don't understand where the President has this authority under the constitution.

"..the Obama administration feels it’s government’s right, it’s duty to be in all aspects of our lives, but will “accommodate” when it’s politically expedient."

Two steps left, one step right. This isn't "rule of law." It is administrative dictatorship modified by cronyism and pull.

To me, it's similar to the courts OKing the suppression of bondholders' rights in the auto bailouts after the government pressured the bondholders with nonspecific threats of with-holding other business relations. It meets the letter of the law, albeit in a perverse way. It only meets the letter because HHS dicator Sibelius can do whatever the hell she wants, as Obamacare is written.

I agree - the ability to grant waivers violates the equal protection under the law concept.

Can Obamacare get rescinded already?

(Newt promised to rescind is before his inaugural ball. Go Newt!)

You know, as a history student of WWII, I have closely followed the rise of Adolf Hitler in post WWI times in earnest. I have believed from day one that POTUS Obama is following the same exact path to dictatorship. He is actually much worse then Hitler, because he has his own statism double in his control freak, hate America wife, Michelle Obama.

I also firmly believe that neither Obama, nor his wife are Christians. Add to that their hate for Jews, Catholics and all other Christians and you come up with two options. Either they are both devout Muslims or they believe in no God whatsoever, other then themselves.

It is really a tragedy that the American people are so easily fooled, by these egomaniac destroyers of the American nation. In my heart of hearts, in my soul of souls, I pray that the American people wake-up and soundly defeat these evil doers, come November,2012.

If not, the Obamas, turned loose, will go forward from issuing 7 enforcing mandates of federal law and regulation, onward to the “Night of the Long Knives”!!! These two people are capable of any means to keep and control the state and all who reside in it!!! America, beware!!!

see post 25 - one article out of many that described the exemption given to Amish & Muslims.

Also....Krauthammer has an excellent column on National Review online as to why catholic charities and hospitals are not considered “religious” as defined by Sebellius.

Obama will not back down. He will simply try to use a different lie. Remember that any ‘compromise’ by Obama expires after the November election. Then he will no doubt stab those who compromised with him in the back, again.

I think the GOP should call his bluff and pass a bill that would make it illegal for Obama to try this again and then see if he will sign.

Only muslims work in mosques

“Here’s what you should know about the Islamic view on abortion.

In General, Abortion is Forbidden

For most instances, Islam forbids abortion. For instance, if a woman becomes pregnant due to committing fornication or adultery, she cannot abort her child simply to avoid shame or hide her sin.

Likewise, if a man impregnates a women, whether she is his wife or not, he cannot force her to get an abortion, regardless of his reason for doing so. He cannot request her to abort her child to save face or because he fears he may not be able to take care of the child.

Allah tells His messenger Prophet Muhammad (peace be upon him) what translates to:

O Prophet! If believing women come unto thee, taking oath of allegiance unto thee that they will ascribe nothing as partner unto Allah, and will neither steal nor commit adultery nor kill their children, nor produce any lie that they have devised between their hands and feet, nor disobey thee in what is right, then accept their allegiance and ask Allah to forgive them. Lo! Allah is Forgiving, Merciful.

But There Are Exceptions

However, there are exceptions to this general rule. Islam is a comprehensive faith that satisfies all of our needs. And whether we like it or not, or want to admit it or not, there are times when an abortion may be necessary. But even these exceptions have very strict limitations.
•If the child has serious deformities, some scholars say the pregnancy can be terminated. However, this must be done before the soul is breathed into the child, that is within the first 120 days, or four months.
•In cases of rape or incest, most scholars agree that a woman can end her pregnancy. If a woman is victimized in such a manner, the abortion should be done within the first forty days. (It should be noted that she does also have the right to carry the child to term, if she wants.) Once again, after 120 days, it is not permissible to abort the child.
•If the mother’s life will be put in danger by giving birth, the fetus can be aborted. This is the only case where the fetus can be aborted even after four months.

Ending a pregnancy is a tremendous decision for the mother. Whatever a woman’s reason for considering an abortion, it should be done so with deliberation and care. Fortunately, we have wisdom and scholarship to guide us to making the correct decisions.

And Allah knows best.”

And from the same site:

“General Islamic Ruling on Contraception and Birth Control

In general, most forms of contraception and birth control are forbidden. But since Islam is a complete religion, we have the benefit of the Quran, the hadith and traditions of Prophet Muhammad (peace be upon him), the companions, and many learned scholars to help us come to an informed decision.

First, any sort of permanent birth control that is not for medical reasons is forbidden. So any medical procedure that leads to complete sterilization and is not medically required, is not allowed. This goes against the teachings of our Prophet Muhammad and if not done for medical reasons, is usually done for vain, selfish or impractical purpose.

For instance, some people have the foolish notion that the world is becoming overpopulated and the earth’s resources are running out. But Allah has made His earth bountiful, and if we trust in Him, there is certainly enough food and water and air to go around.

Wherever there is starvation in the world, there is needless gluttony and waste elsewhere. So the problem is not a lack of resource but a lack of compassion for those who are less fortunate than us.

How can Zakah ease world suffering?

Now, let’s look at the different types of birth control and the rulings on each of them.

Surgical Contraception

There are two primary forms of surgical contraception:
1.Vasectomy – Where the Vas deferens of a man are cut and tied to prevent the passage of sperm from the testicles to the semen. This procedure allows a man to have intercourse and ejaculate, but not transfer sperm to his wife, hence she will not get pregnant.
2.Hysterectomy – This procedure involves surgically removing the uterus from a woman. This results in permanent sterilization for the woman.

Vasectomy

It is not permissible for a man to have a vasectomy. There is no medical reason that warrants such a procedure. Hence, every reputable scholar in Islam has ruled that vasectomies are haram, or forbidden. The only reason a man would want to have such a procedure is to have sex without the responsibility of rearing children.

Hysterectomy

Hysterectomies are the most common gynecological procedure done in the United States, with over half a million performed each year. Most of these are not for serious medical reasons. It is not permissible for women to have a hysterectomy for any reason except where getting pregnant may endanger her life. So, if having children may kill the mother, and there is no hope of curing or reversing this condition, then it is permissible for her to have her uterus removed.

Medical Contraception

Medical contraceptions are birth control methods that typically disrupt the natural hormonal or menstrual cycle of a woman in order to prevent pregnancy. There are many different forms of medical contraception, most of them temporary. But there are also a few permanent ones.

Temporary Birth Control

These include the Combined Oral Contraceptive Pill, aka “The Pill,” patches, and other drugs that temporarily prevent birth.

In Islam, these methods are usually prohibited unless both of the following conditions are met:
1.There is a medical reason for doing so.
2.The husband agrees.”

I believe this ‘accommodation’ is actually ‘hudna’: postponement to regroup and attack in force.

“Nowhere is power (or the lack thereof) more clearly understood than in Middle Eastern culture. Coming from a Western perspective, we continually fail to recognize that concessions, territorial withdrawals, and our efforts at compromise, contrition, accommodation, dialogue and appeasement are perceived by our enemies in the Arab/Muslim world as symptomatic of our weakness and merely reinforce what they have already come to believe - that Western democracies are “paper tigers” (to use bin Laden’s term) and easy prey.”\

This edict announced today is no "accommodation," nor is it a compromise. All it represents is government switching its odious curse of a mandate from religious institutions to secular insurance companies. Neither dictate is constitutional.

Predictably, the woman who desires contraceptive medical services isn't granted the option or isn't trusted with the option of paying for them herself. It's another step on the road to tyranny, if implemented.

And who's ox is being gored under this new mandate? Initially, the insurance company who provides the supposed freebees or the holder of the insurance policy(s) (employers and/or employees), who will be charged increased premiums to cover the additional expenses.

But eventually, that health insurance market will collapse because it will become unattractive to both sellers and buyers to contract under these government-dictated parameters. Then, as ObamaCare advocates envisioned, Big Brother will step in and fill the vacuum with a single payer system and the nightmare of fully nationalized health care will befall us - just as in Canada, where the people made that disastrous mistake a couple of decades ago, and don't seem willing to correct it even with a "conservative" government in power.

The Tea Party better show that they're alive and ready to defend our freedom at the ballot box this November.

Not only the Tea Party, but all of us! Fortunately, all Pubbies in the presidential race are on record for repeal of ObamaCare - although there is some reason to question Romney's commitment because of his history in Taxachusetts. We'll need not only a pro-repeal president, but a pro-repeal House and a pro-repeal Senate that can overcome a filibuster effort.

What’s just is important is that there are already plenty of places to get free contraceptives and people don’t need such coverage.
