Well, remember that this is an election year. If she retired now, or in the summer after this year’s Supreme Court session is done, there would be a huge confirmation battle. And that confirmation battle would be a major campaign issue this year.
Let’s all remember, that of 33 Senate seats up for election this year, 23 are Democrats, a number of whom are vulnerable for re-election. It’s possible that Republicans will control the Senate come next January. Then, if Obama is re-elected, and Ginsburg retires, Obama will have a much tougher time appointing a strong liberal.
Or I should say, he will have a tough time appointing that liberal, unless he continues to make recess appointments to positions and not be challenged on doing so.
