Methinks California would like to apply the penalty more liberally,.....against.....us, for instance.
After all, with the Ninth Circuit in charge, “THEY” remain quite protected.

Even Feinstein supports it.

California has it’s own unique form of the death penalty. The whole friggin’ state is dying from liberal idiocy. Now that’s what I call a death penalty...

So,
Majority is in favor of gay marriage = majority is smart, pass it.
Majority in favor of death penalty = majority is wrong, they need re-education.

Sure, Californians support it but the state doesn't have it. More condemned have died of suicide or natural causes than execution. We've gone years waiting for ONE judge to be satisfied with our lethal injection procedures only to be stymied by Obama's FDA and it's war on death penalty states over sodium thiopental supplies and "safe" alternatives.
The last I calculated, CA would have to execute one person per month for nearly 60 years to clear Death Row, assuming no one else is added. There are some still waiting since Carter was president. It's madness and there appears to be nothing CA voters can do about making their justice system work.
