Why should it not go? The democrats played games to get 0bamacare passed. They were the ones that didn’t put the severability clause in it. Did any of the justices ask why a severability clause wasn’t in this legislation? The whole thing should go.
If I remember correctly, the bill was in the process of going back and forth between the Senate and House when Brown was elected. It would not then survive another round of reconciliation so Queen Nancy “deemed” it passed. They just stopped the process when they lost the 60th Senate vote and moved it into the passed column. That alone means it is “one big package.”
