(Duke) lacrosse accuser (Crystal Mangum) wants murder charge dismissed, new judge

Durham, N.C. — The Durham woman who falsely accused three Duke University lacrosse players of rape in 2006 filed motions Thursday asking that a murder charge against her be dismissed and that the judge in the case to recuse himself.

Crystal Mangum, 32, is charged in the death of Reginald Daye, 46, who was stabbed with a kitchen knife during an April 3, 2011, argument at his Durham apartment, police said. They had been dating for about a month at the time of his death.

Mangum filed the motions herself, with the assistance of a supporter who isn't an attorney. The motions state that Mangum isn't happy with the work of her court-appointed lawyer.

The dismissal motion alleges that Mangum was defending herself against a drunken Daye when the stabbing occurred. It also alleges that the stab wound didn't kill Daye, who died more than a week later at Duke University Hospital, suggesting instead that other health problems led to his death.

Mangum also asked that Superior Court Judge Osmond Smith remove himself from the case, citing his involvement in the Duke lacrosse case and alleging that his rulings show bias against her.

Maybe she can get that disgraced ex-DA, whatzizdingie, to represent her. I'm sure he's not too busy to take up the case (if he's outta jail).

Mangrum is not cooling her ass in jail for filing blatantly false charges against 3 wholly innocent young white men.

However, his power to pardon offenses against federal crimes is unlimited, which I think is perhaps the only such power in the Constitution. It’s never been dramatically abused, but the potential is there.

In a book I read recently, a wave of terrorism led Congress to pass a law giving jurisdiction over politically-inspired violence solely to the federal system.

The President promptly started pardoning anyone who killed one of his political enemies, giving him essentially the power to order executions at will. Entirely Constitutional, too.
