Toledo police: shooting of burglar justified(OH)

A burglar is still recovering after being shot by a homeowner. Toledo police say, under the law, the homeowner had every right to shoot.

Toledo police say, if someone breaks into your home, you have a right to protect yourself. You can have a fire arm inside your home without having a concealed carry permit.

Toledo police say the homeowner who shot Victor Stubblefield Jr. did the right thing.

The 49-year-old was shot after he broke into a Point Place home. The homeowner, who wants to remain anonymous, says he came face to face with the suspect in his hallway.

"He was literally three to five feet away from me, and I was concerned that he was going to harm my family or even myself," the homeowner says. "Once someone's in your house, that far into it, there was no question in my mind. I had to do what I had to do."

It all happened early Saturday morning. Police say the suspect used a crowbar to break in.

The 38-year-old homeowner says his wife woke him up when she noticed someone turn their bedroom light on and off.

The husband shot the suspect in the chest and arm after confronting him in the hallway.

Ohio's Castle Doctrine says a homeowner can use deadly force if someone breaks into their home.

"The homeowner did the right thing," says Sergeant Joe Heffernan. "Once the burglar went down and was no longer a threat, the homeowner called the police. Police got there right away and were able to take care of the situation from there. The homeowner acted, in our opinion, just as he should have. He used the proper amount of force necessary."

Stubblefield remains in the hospital at Mercy St V's in fair condition. Once he's released, police say he will face aggravated burglary charges.

Stubblefield's family declined to comment about the incident.

Dumb criminal alert - what are the chances the homeowner will be in the bedroom in the wee hours?

Ohio's Castle Doctrine says a homeowner can use deadly force if someone breaks into their home.

While such a law is a good thing, the implication (once again) is that rights are granted by the state.

I notice that as these incidents increase (or least receive more coverage) the police are dispensing with the anti-gun, let-us-enforce-the-law boilerplate. Either they supported such actions all along or they are coming around to the proper viewpoint.

Just remember, if the intruder is “Amish” you will have Obama, Holder and the entire state sponsored media calling you a criminal.

Absolutely. Also, IIRC, there seem to be more and more posts like this one here on FR, meaning exercise of Second Amendment rights by the law abiding population of all races is having a greater and greater impact on violent crime. This, of course, means that the criminal enabling community, AKA "civil rights" organizations and the DemonRat party, is getting totally desperate to suppress those who exercise their Second Amendment rights, like the totally innocent George Zimmerman, who legally, morally, and legitimately killed the wannabe murderer Trayvon Martin.

It very much depends in which state the shooting takes place.

If we lose the right to defend ourselves, police officers lose the right to defend themselves. Self defense and the wisdom and character to use it properly, is important for survival in modern nuttso America.

From the viewpoint of the responding police, having the bad guy being on the floor of the homeowner's bedroom is a no-hassle arrest with a pretty-much guaranteed conviction. This pleases both the cops and the prosecutor.

They are less pleased when the perp is dead, because there's they don't get an arrest/conviction out of it.
